BY THE COURT :
The petitioners who are presently undergoing their Basic Training Course (BSTC)/B.Ed., submitted their applications in pursuant to advertisement dated 31.5.2008. As per Note-2 appended to the advertisement, applicants holding professional qualification diploma/certificate in Nursery Teachers Training PTT or Pre-Primary Teachers Training are permitted to participate in process of selection with the condition that till they acquire the training of BSTC/B.Ed. or Bridge Course as the case may be, if they be selected will be appointed with a stipend of Rs.2750/- and will get appointment on attaining the training or bridge course as per Rules of 2008.
The case of the petitioners is that the respondents are permitting the persons having certificate of NTT or Pre Primary Teachers Training Course then there is no just and valid reason to deny the same to the persons like petitioners who are undergoing BSTC/B.Ed. or who have already appeared in BSTC Examination but have awarded supplementary. As 8 per the petitioners the act of the respondents is a discrimination and that is in violation of Article 14 and 16 of the Constitution of India.
The controversy involved in these petitions has already been adjudicated by this Court in a batch of writ petitions decided on 11.9.2008 alongwith SBCivil Writ Petition No.8232/2008 (Purshottam Mehta & 37 Ors. Vs. State of Raj. & Ors.). While rejecting all those petitions, a specific finding is given by this Court in the case aforesaid that the applicants holding professional qualification under NCTE Regulations, 2001 constitutes a separate class and therefore the qualification made under the Rules of 2008 is having reasonable nexus with the object sought to be achieved.
The present petitions for writ also stand dismissed in light of the judgment referred above.
