Section 9(2) in Central Electricity Regulatory Commission (Grant of Connectivity, Long-term Access and Medium-term Open Access in inter-State Transmission and related matters) Regulations, 2009
(2)Medium-term open access shall be granted if the resultant power flow can be accommodated in the existing transmission system or the transmission system under execution:Provided that no augmentation shall be carried out to the transmission system for the sole purpose of granting medium-term open access:Provided further that construction of a dedicated transmission line shall not be construed as augmentation of the transmission system for the purpose of this regulation.
