Section 21B in The Bihar Co-operative Societies Rules, 1959
21B.
Subject to the general superintendence, direction and control of the Registrar, Co-operative Societies, the power to conduct elections in a Cooperative Society or class or classes of Co-operative Societies shall vest in the following officers, who for this purpose, shall be called Conducting Officer:-(i)the Registrar, Co-operative Societies, or an officer not below the rank of Joint Registrar/Co-operative Societies authorised by him in respect, of Apex Societies or class of Co-operative Societies as may be specified by the Registrar;(ii)The District Officer/Deputy Commissioner of a district or an officer not below the rank of Additional Collector authorised by him in respect of Central Co-operative Societies including Central Co-operative Banks : Provided that if the territorial jurisdiction of a Central Co-operative Society extends beyond the territorial boundary of one district the District Officer/Deputy Commissioner of the District in which headquarters of the society is situated shall have power to, conduct elections in that society;Provided further that the Managing Director of Bihar State Co-operative Milk Producers' Federation Ltd., Patna shall have power to conduct elections in the Milk Producers Co-operative Unions affiliated with the Federation :Provided also that the Additional/Joint Registrar, Co-operative Societies of the concerned Division shall have power to conduct elections in the Vyapar Mandal Co-operative Societies of that Division :(iii)The Assistant Registrar, Co-operative Societies of the concerned circle in respect of Primary Co-operative Societies :Provided that the Managing Director of Bihar State Co-operative Milk Producers' Federation Ltd., Patna shall have power to conduct elections in the Milk Producers' Co-operative Societies affiliated to Milk Producers' Co-operative Unions and the Bihar State Co-operative Milk Producers' Federation Ltd.
