ORDER
This is filed application filed by the applicant under Section 482 of the B.N.S.S. for grant of bail. The applicant apprehends his arrest in connection with Crime No.539 of 2026 registered at Police Station Excise (Internal Circle) District Gwalior (M.P.) for the offence under Sections 34(1)(a) and 34(2) of the Excise Act.
2. During the course of arguments, learned counsel for applicant requested to withdraw this application and also requested that direction may be issued to the Investigating Officer/Trial Court to comply with the directions of Hon'ble Apex Court in the Case of ArneshKumar Vs. State of Bihar [(2014) 8 SCC 273] and Satender Kumar Antil Vs. Central Bureau of Investigation [(2022) 10 SCC 51], Siddharth Vs. State of U.P. and anr. [(2022) 1 SCC 676] and Aman Preet Singh Vs. 3. After considering the arguments, fact and circumstances of the case, request is accepted.
4. However, it is expected that Investigating Officer/Trial Court/police authorities shall ensure strict compliance of the guidelines and directions as laid down by Hon'ble Apex Court in the case of Arnesh Kumar (Supra), Satender Kumar Antil (Supra), Siddharth (supra) and Aman Preet Singh (supra).
5. With aforesaid direction, this application is disposed of.
