(3)When a Court starts an inquiry under Section 476 of the Code of Criminal Procedure suo motu, diet-money shall be paid from contingencies the charges being debited to the head "Diet-money and travelling expenses of witnesses" to be opened under "Countersigned Contingencies". In other cases the person at whose instance the inquiry is made shall be required to tender diet money payable to witnesses as in a suit.
