The question involved in all these writ petitions is as to obligation of the State Government to satisfy the claim of the employees of the non-government aided educational institutions towards arrears of salary, selection grade, recommendation of Pay Commissions, leave encashment or any other claim for which grant-in-aid is admissible, which has already been adjudicated upon by the Rajasthan Non-Government Educational Institutions Tribunal (for brevity, "the learned Tribunal") and their claim for payment is still pending at various levels including the Executing Court.
Major R.P. Singh, learned Additional Advocate General alongwith Mr. C.L. Saini, learned Additional Advocate General, Mr. Ganesh Meena, learned Additional Advocate General and Dr. Vibhuti Bhushan Sharma, learned Additional Advocate Genral submitted that the State Government shall pay the due amount of the employees of the aided education institutions directly to them within a period of 60 days from the date of submission either by the employees or by the educational institutions of their respective claim which has already been adjudicated upon by the learned Tribunal, in terms of direction of the Hon'ble Apex Court of India dated 09.09.2021 in case of State of Rajasthan Vs. Manju Saxena & Ors.: Special Leave to Appeal (c) No.13791/2019.
Learned counsels for the petitioners have no objection to the aforesaid submission. However, they submitted that in some of the cases, the aided institutions have already paid entire dues of their employees in terms of direction issued by the learned Tribunal but, (Downloaded on 18/02/2022 at 09:16:55 PM) (31 of 32) [WRW-300/2017] they have not been paid the corresponding amount of grant-in-aid and therefore, the respondents may also be directed to make such payment to the institutions.
The respondents have no objection to the aforesaid prayer.
In view thereof, with the consent of the learned counsels for the respective parties, all these matters are being disposed of with following directions:
(i) The employees/Managing Committees of the aided educational institutions shall submit their claim with the respondents within a period of 15 days from today. However, claim of any of the employees/Managing Committee of an aided education institutions shall not be rejected merely on account of its submission beyond the aforesaid period of 15 days.
(ii) The State Government shall ensure payment of dues barring gratuity to the employees of the aided institutions in terms of directions issued by the learned Tribunal after verifying the claim so made within a period of 60 days of its submission.
(iii) The State Government shall, in accordance with law, be entitled to recover this amount from the institutions, if such institution had drawn grant-in-aid in excess of its entitlement.
(iv) The State Government shall ensure payment of arrears of grant-in-aid to those education institutions who have already paid the entire dues of their employee(s).
(v) The aforesaid payment of the grant-in- aid to the educational institutions shall be payable only if they pay, if not already paid their share of (Downloaded on 18/02/2022 at 09:16:55 PM) (32 of 32) [WRW-300/2017] the dues to their employees, within a period of 60 days from today.
(vi) The directions issued by the learned Tribunal to the contrary, shall stand modified accordingly except qua gratuity.
(vii) If the directions are not complied with within the stipulated period, the dues of the employees/arrears of grant-in-aid shall carry interest @ of 9% per annum from today.
