ORAL ORDER
6 05-05-20251. Heard the parties.
2. A common question is involved in all these writ petitions that the petitioners, who are female candidates from the neighbouring states are entitled for benefit of relaxation of minimum marks from 60% to 55% in the eligibility test i.e. CTET. The appointment of the petitioners were cancelled vide memo no. 4349 dated 01.07.2024. In some of these writ petitions memo no. 4349 dated 01.07.2024 has been challenged by way of I.A. No. 1 / 2024.
3. Learned senior counsels for the petitioners submits that same impugned order passed by respondent authority has been stayed by a co-ordinate Bench of this court in C.W.J.C. No. 18786 of 2024 by order dated 20.03.2025. Several other interim orders on similar issues have been passed by this court as well as other co-ordinate Benches in C.W.J.C. Nos. 17078 / 2024 (Nidhi Gupta & Ors. versus The State of Bihar & Ors.), 18343 / 2024 (Shweta Gupta & Ors. versus The State of Bihar & Ors.), 16596 / 2024 (Priya Verma & Ors. versus The State of Bihar & Ors.). Accordingly, submission is that similar treatment may be Patna High Court CWJC No.9209 of 2024(6) dt.05-05-2025 9/10 given to the petitioners, who are similarly situated.
4. On the other hand, Ms. Surya Nilambari, learned counsel for the State submits that in the case of Priya Bhadauriya & Ors. vs The State of Bihar & Ors. in C.W.J.C. No. 9574 / 2024, Ibtesham Shaheen vs The State of Bihar & Ors. in C.W.J.C. No. 9209 / 2024 and Shweta Yadav vs The State of Bihar & Ors. in C.W.J.C. No. 12545 / 2024 a co-ordinate Bench of this court has occasion to pass interim order and by order dated 03.10.2024 this court has said that those petitioners who have already been terminated and have challenged the termination order, the impugned order, shall be subject to the final result of the writ petitions and in respect of those petitioners who have not yet been terminated but show cause notices have been issued to them status quo with regard to their services shall be maintained. Accordingly, she submits that if the impugned order of termination is stayed it will amount to modification of the order dated 03.10.2024 passed by a co-ordinate Bench.
5. I have heard learned counsel for the parties and have perused the various order passed by this court on similar issue. It appears that termination letters / orders of similarly situated teachers have been stayed by different Benches of this court. The issue involved in all these cases are identical, as such, Patna High Court CWJC No.9209 of 2024(6) dt.05-05-2025 10/10 termination order dated 01.07.2024 having memo no. 4349 with respect to the aforesaid petitioners including petitioners of C.W.J.C. No. 9574 / 2024 (Priya Bhadauriya & Ors vs. The State of Bihar & Ors.) and C.W.J.C. No. 9209 / 2024 (Ibtesham Shaheen vs The State of Bihar ) shall remain stayed till further order.
6. The order dated 03.10.2024 passed in C.W.J.C. No. 9209 of 2024 (Ibtesham Shaheen vs The State of Bihar & Ors.), C.W.J.C.
