1. This is an application filed on behalf of the respondent seeking to remit the entire principal amount along with interest which has accrued on Demand Draft No. 000947 in favour of the respondent.

2. The amount of Rs. 1 lakh was deposited by the respondent pursuant to an order dated 15.02.2021, which was subject to the final outcome of the pending suit between the parties.

3. Mr Thakur, learned counsel for the respondent has drawn my attention to Annexure R-6 (order dated 20.03.2023) with the application wherein the suit for possession, recovery of arrears of rent and utility charges, mesne profits and mandatory injunction have been decreed in favour of the respondent and the appellant has been directed to pay Rs. 8,89,500/- towards arrears of rent and mesne profits along with interest @ 6% per annum.

4. Mr Thakur, learned counsel for the respondent states that to the best of his knowledge, no appeal has been filed against the judgment and decree dated 20.03.2023. Hence, the amount of Rs. 1 lakh is payable to the respondent towards part payment of the decree.

5. The Registrar General is directed to release the amount of Rs.1 lakh along with accrued interest in favour of the respondent through counsel and the same shall be construed as a payment towards Rs. 8,89,500/-.

6. The application is disposed of accordingly.

6. Ms Bhadouriya assures the Court that appropriate action shall be taken to ensure that all illegal and unauthorized construction is removed. She states that further demolition action is planned for 24.12.2023 or near about.

7. The demolition action shall be undertaken and a report in this regard will be furnished to the petitioner.

8. With these directions, the present contempt petition is disposed of.

9. In case the petitioner is still aggrieved the petitioner shall be at liberty to revive the contempt petition.

Sunil Kumar' wherein the suit for recovery filed by the appellant was dismissed on account of limitation. Operative portion of the said impugned judgment reads as under:

"28. The onus to prove both these issues was upon the plaintiff. In view of the above discussion in issue no. 2, as the suit is barred by limitation, the plaintiff is not entitled to the relief as claimed. Hence, these issues are decided in the favour of the defendant and against the plaintiff."

He states that the limitation is to start from the date of default which in the present case was March, 2017 and hence the suit was filed within the period of limitation.

The Order is downloaded from the DHC Server on 08/12/2023 at 01:30:56 handed over a status report indicating detailed drives undertaken on 09.09.2023, 19.09.2023, 22.09.2023, 30.09.2023, 20.10.2023, 09.11.2023, 16.11.2023 and 23.11.2023. Along with the affidavit he has also shown photographs wherein the encroachments have been removed.

From the affidavit filed by the MCD as well as the respondent No.2- Delhi Police, I am satisfied that the directions contained in the orders dated 09.09.2005 passed in CM No.9782/2005 in W.P.(C) 5239/2002 have been complied with by the respondents. The respondents are directed to scrupulously ensure that the area is kept encroachment free and there is no unregulated hawking or traffic issues.

4. With these directions, the contempt petition is disposed of.

5. In case the petitioner is aggrieved, the petitioner is at liberty to file an appropriate petition in this regard.

6. The status report handed over in Court today is taken on record.
