Reply is stated to have been filed in the Registry, however, the same is not on record. Registry is directed to trace and place the same on record, even if it is under objection.
It is not in dispute that the petitioner has executed the work for a sum of Rs. 1,17,08,009/- as against total work for a sum of Rs. 3,80,02,194/-. However, a single penny has yet not been paid to the petitioner. In such circumstances, it cannot be expected from the petitioner to execute the remaining work.
Therefore, clear instructions, in this regard, be obtained by the next date of hearing.
