Information sought:
1- Philately exhibition was held in D. N. College Hisar on 08/12/2011. Kindly intimate the total expenditure incurred on the exhibition alongwith the photocopy of the vouchers in support of the expenditure. The particulars viz. name of the officers/officials to whom the prizes were given alongwith the photocopies of the bills in respect of the prizes given on this occasion and the description of the prizes given to the individual may also be given. 2- Photocopy of the diary of Sh. Sadhu Ram Sharma SPO's Hisar for the month of December 2011 be given.
3- How many posts of GDS BPM, EDMAIL peon, EDDA are vacant in Hisar Division with the number of posts against which approval has been received for filling the vacancies by the SPO's Hisar.
4- How many posts have been filled up so far with the vacancies still not filled up for each category. Action taken by the SPO's Hisar to fill up the vacancies may kindly also be intimated.
5- Particular of the officials transferred in the last year were sent on department alongwith the names of the offices where deputed and the period of their deputation in that office may kindly be intimated.
6- The total number of RPLI policies in which medical examination of the insurant got from Bhiwani alongwith the total fee paid to the concerned doctors at Bhiwani may kindly be intimated. The names of the doctors from whom the medical examination got done and through whom may also be given. This information for the period since the joining of Sh. Sadhu Ram Sharma as SPO Hisar be given.
7- Total numbers of RPLI cases in which medical examination of the insurants was got done from Hisar, Sirsa and Fatehabad and total fee paid to the doctors at these stations for this purpose may be intimated. This information for the period since the joining of Sh. Sadhu Ram Sharma SPO's Hisar be given. Mode of getting the medical examination of these stations may also be given.
8- The particulars of the residence with full address where Sh. Sadhu Ram Sharma SPO's Hisar has been living since his transfer as SPO's Hisar may kindly be given.
Grounds for the Second Appeal:
The replies received from PIO are incomplete and unsatisfactory.
Relevant Facts emerging during Hearing:
The following were present Appellant: Mr. B D Singla appellant's representative through VC Respondent: Mr. S K Sharma APIO Ambala & Mr. Sadhu Ram Sharma Hisar CPIO through VC M: 9416057211) The appellant's representative stated that he wants the following information:
(i) The total expenditure incurred in a philately exhibition held at Hisar on 08/12/2011, the names of the persons who were given awards and the description of prizes.
(ii) The total amount of fee paid to doctors at Bhiwani for examining PLI beneficiaries during the tenure of Shri S R Sharma as SPO Hisar along with the number of beneficiaries in respect whom the fee was paid.
(iii) Total amount of fee paid to doctors for examining PLI beneficiaries at Hisar, Fatehabad and Sirsa during the tenure of Sh. Sadhu Ram Sharma as SPO Hisar along with the number of beneficiaries in respect whom the fee was paid.Page 2 of 3
(iv) Residential address of Shri Sadhu Ram Sharma at Hisar during his positing at that centre.
The CPIO Hisar stated that the information relating to item (i) (ii) & (iii) above is under vigilance investigation and the relevant files are under the custody of Mr. Ved Prakash Dhiman ASPO/Mr. Inder Jit Singh Thakur Asst. Director(Vigilance) Circle office Ambala(Tel:0171 2688412) and, hence, exempt under Section 8(1)(h) of the RTI Act. As regards the information sought under item
(iv) viz. residential address at Hisar the CPIO Shri Sadhu Ram Sharma explained that he has made his own arrangement and no official residence has been provided and if his private residential address is disclosed his personal safety will be threatened; he claimed exemption under Section 8(1)(g)&(j) of the RTI Act.
Decision notice:
The Commission directs the CPIO Vigilance, Ambala Circle to furnish a declaration to the appellant confirming that the information sought under items (i)(ii) & (iii) above are under investigation and hence exempt under Section 8(1)(h) of the RTI Act. The CPIO Hisar should furnish an appropriate declaration to the appellant confirming that no official/subsidized accommodation has been provided to Shri Sadhu Ram Sharma SPO at Hisar. The declarations as above should be provided to the appellant within 15 days from the date of receipt of this order.
The appeal is disposed of accordingly.
