1. Revision Petitions (RPs) No. 2281 to 2303 of 2023 and RP No. 1320 to 1324 of 2024 have been filed by the Petitioner(s) ( Original Complainants before the District Forum) against the Respondent (s) ( original Opposite Party (ies) before the District Forum), while RP Nos. 1076 to 1104 of 2024 have been filed by the OP (s) against the Complainant(s) against the similar order(s) dated 05.12.2022 of the State Consumer Disputes Redressal Commission Maharashtra (hereinafter referred to as the `State Commission'), inter alia praying for setting aside the order(s) of the State Commission dated 05.12.2022. All the RPs have been filed with a delay ranging from 57 -353 RP/2281/2023 and connected RPs Page 36 of 68 r,.

days. Keeping in view the importance of the issues involved and in the interest of justice, delay in filing the RPs is condoned and cases are taken up on merits.

As these RPs involve similar facts and common question of law, hence they are taken up together with RP No. 2281 of 2023 as lead case for the RPs filed by the Complainant(s) and RP No. 1076 of 2024 as lead case for the RPs filed by the 0P(s). For sake of convenience,, parties will also be referred to as they were arrayed before District Forum.

Facts of the lead case i.e. RP No. 2281 of 2023 filed by the Complainant Brief facts of the case, as presented by the Complainant and as emerged from the RP, Order of the State Commission, Order of the District Forum and other case records are that the complainant, Shri Shankarrao Pangavhane, an agriculturist and customer of Nashik District Central Co-

operative Bank Limited (hereinafter referred to as Bank), had hired Locker No. 38 in Ranwad branch of the Bank in the year 1996 on payment of annual rent of Rs. 790/-. He had kept gold ornaments / other valuables weighing 458.710 grams belonging to himself and his joint family in the said locker. It is the case of the complainant that that Bank had entered into an agreement and agreed that gold ornaments of the complainant would be kept safely in the locker.

The bank had assured safe custody of the locker contents and represented that adequate safety precautions were in place.

On 24.08.2015, the complainant came to know from the Branch Manager: that robbery had taken place in the Ranwad Branch of the Bank and robbers had entered into the bank's strong room and committed theft of gold ornaments from various lockers. The complainant alleged that the theft occurred due to gross negligence and deficiency in service on the part of the bank, as there were no CCTV cameras in and around the lockers, no alarm system and lack of security guards.

The complainant demanded compensation by letter dated 05.10.2015 for the loss of gold ornaments weighing 458.710 grams. However, the Branch Manager denied knowledge of the valuables kept in the locker and merely informed that a police complaint had been lodged at Pimpalgaon Baswant Police Station and that information would be given upon recovery. The complainant contended that he was a consumer of the bank and that the loss was solely due to the bank's failure to take necessary safety' measures, amounting to deficiency in service. Being aggrieved, the complainant filed Consumer Complaint before the District Commission and District Commission vide order dated 30.01.2017 directed the OP(s) to separately and jointly pay to the complainant within one month from the date of the order the value of 430 grams of gold as per the market price prevailing on the day of the theft as compensation. OP(s) were also directed to pay Rs.25,000/- for mental distress and Rs. 10,000/- towards cost. Being aggrieved with the said order of the District Commission, the OP(s) preferred an Appeal before the State Commission and State Commission vide order dated 05.12.2022 partly RP/2281/2023 and connected RPs Page 38 of 68 allowed the appeal and awarded only compensation of Rs.3,00,000/- towards mental and physical harassment and amount of Rs.50,000/- towards cost within 3 months against OP No.1 before the District Forum. Therefore, both Complainant(s) and OP(s) are before this Commission now in the present RP(s). Complainant has challenged the order of the State Commission which modified the order of the District Commission with respect to ordering the payment of market value of the stolen articles while OP(s) has challenged the order of the State Commission on account of enhancement of compensation for mental and physical harassment and litigation cost.

6. Petitioner(s) in RP No. 2281 of 2023 ( complainant) has challenged the said Order dated 05.12.2022 of the State Commission mainly on following grounds:

State Commission failed to consider that the Petitioner had annexed all original bills / invoices issued by each jeweller which shows that Petitioner had paid the bill amount and those are not merely bills, those invoices are payment received by the jewellers. Petitioner has also filed his self-affidavit, affidavit of the relatives stating that those ornaments and invoices belong to the Petitioner. State Commission failed to consider that Police Authority has executed the Panchnama and recorded the statement of Petitioner in the FIR. State Commission erroneously concluded that Petitioner has not led any evidence as to when the gold ornaments belonging to him and his entire family came to be kept in the locker of the bank. State Commission failed to consider that Respondent themselves has filled the locker register which shows that prior to the incident of the theft, the Petitioner had operated the locker allotted to him.

State Commission failed to consider the judgment passed by National Commission in Ashok Babaji Ghogare Vs. Pune Zila Madhyawarti Sahakati Bank Ltd. -- RP No. 1291 of 2015 where in it is held that complaints under the Consumer Act cannot be dealt with the detailed evidence.
State Commission failed to distinguish the case of Amitabh Dasgupta Vs. United Bank of India and Ors. -- Civil Appeal No. 3966 of 2010 with the case of Ashok Babaji Ghogare Vs. Pune District Cooperative bank and further the ratio laid down in the case of Ashok Babaji is squarely applicable to the present case. State Commission erroneously granted the compensation only for the mental and physical harassment and towards the cost. The compensation should have included the cost of the gold which was kept in the locker of the bank.
The impugned judgment is a non speaking order.

7. Petitioner / OP(s) in RP No. 1076 of 2024 ( lead case of the OPs) has challenged the said Order dated 05.12.2022 of the State Commission mainly on following grounds:

Order passed by the State Commission is illegal, bad in law and contrary to the settled position of law.
State Commission by following the decision of the Apex Court in case of Amitabh Dasgupta Vs. United Bank of India and Ors. was of the opinion that issue involved in the complaint as regards awarding compensation for loss of gold has to be decided by Civil Court by adducing appropriate evidence and that State Commission awarded compensation of Rs.3,00,000/- and cost of Rs.50,000/- when the complainant himself had claimed compensation of Rs.50,000/- and cost of Rs.10,000/- and when there was no separate appeal preferred by the complainants for enhancement of compensation. State Commission could have confirmed the order passed by the District Foum in respect of compensation and costs amounting to Rs.25,000/- and Rs.10,000/-.

c. Order passed by the State Commission is beyond the scope of the provisions of Consumer Protection Act.

8. Heard counsels of both sides. Contentions/pleas of the parties, on various issues raised in the RP(s), Written Arguments, and Oral Arguments advanced during the hearing, are summed up below 8.1. Learned counsel for the Complainants apart from repeating the points which have been stated in para 6 argued that that Petitioner has filed the original bills supported with the affidavit which is a documentary proof for corroborating the extent of jewellery placed inside the locker. Further, Petitioner kept the gold ornaments and bills of the said ornaments in their lockers and at the time of incident o€ theft, the thieves looted the golden ornaments and left the bills of the ornaments lying at the spot of the incident.

8.2. Learned counsel for the OP(s) argued that there was no specific agreement / contract between the original complainant and the bank pertaining to the storage of gold ornaments and / or any other valuables / contents in the said locker and, therefore, the Bank was not aware as to what were the contents of the lockers. The Branch Manager of the Bank had clarified that the supplementary FIR had been lodged by him and the gold weight has been mentioned in the respective lockers as per the information derived by him from the respective complainants. The Branch Manager had no personal knowledge about the same. It is further argued that OP in their written version challenged the legality and validity of the said complaint on various grounds including the ground that complainants are not the RP/2281/2023 and connected RPs Page 41 of 68 consumers within the meaning of Consumer Protection Act as there was no locker rent agreement between the parties and pursuant to the terms and conditions, the Bank had not taken any responsibility of the contents of the locker.

8.3. Counsel for the OP(s) further argued that in the written version they have mentioned that OP was not aware whether gold ornament were kept by the complainants in their respective lockers. Further, there was no evidence on record to prove that the alleged ornaments alleged to have been claimed by the complainant belonged to the complainant on the strength of documentary evidence in their respective lockers. Further, complainant has not produced any evidence to show that they had actually kept the gold ornaments in their respective lockers. The Bank had no control over the contents of the locker. Further, Bank was not aware as to what kind of valuables were stored in the respective lockers as on the date of said theft and / or prior thereto. At no point of time prior to filing of the complaint, the complainant alleged that Bank was deficient in protecting the safety and / or security of the said Branch and / or strong room of the branch. It is also argued that no appeal for enhancement of the compensation was filed by the original complainants before the State Commission. Further, on the date of incident, there were no clear cut guidelines of the Reserve Bank of India as regards the security arrangements to be made at the Branch level. In absence of any such guidelines, the State Commission could not have found any fault against the Bank.

8.4. Counsel also argued that when the State Commission had observed in the order that order of the Apex Court in case of Amitabh Dasgupta Vs. United Bank of India and Ors. is squarely applicable to the facts of the present case and elaborate evidence is required to be produced to prove that Complainant had already kept the ornaments in the said locker and what was the actual value of the said ornaments, the State Commission should have simply set aside the order passed by the District Forum and should have returned the complaint to original complainants to be filed before Civil Court or alternatively should have granted liberty in favour of original complainants to file civil suit in accordance with law. Further, when State Commission had come to the conclusion that evidence is required in the above matter, the State Commission ought to have kept all*the issues open to be decided by Civil Court. Further State Commission has also observed that in the present case the complainant has not given details as to when exactly the said gold ornaments came to be kept by the complainant and his relatives in the locker. In absence of any elaborate evidence as regards the ownership of the said locker and as regards the contents of the said locker as on date of theft certainly the said issue cannot be decided within 4 corners of the consumer protection Act by way of summary trial. It is also argued that original complainants have attempted to compare the facts involved in Amitabh Dasgupta Vs. United Bank of India and Ors. as well as case of Pune Zilla Madhawari Sahkari Bank Ltd. Vs. Ashok Bayaji Ghogare and according to the complainant, the judgment in the case of Pune Zilla Madhyawarti Sahakari RP/2281/2023 and connected RPs Page 43 of 68 Bank Ltd is squarely applicable to the facts of the present case. However, the State Commission considered both the judgments and considering the fact that case of Amitabh Dasgupta Vs. United Bank of India and Ors. is the latest judgment and State Commission appears to have followed the same.

8.5. Learned counsel for the OP(s) relied on the judgment of the Hon'ble. Supreme Court in Amitabha Dasgupta Vs. United Bank of India and Ors ( 2021) 14 SCC 177 decided on 19.02.2021 and order of National Commission in Pune Zila Madyawarti Sahakari Bank Vs. Ashok Bayaji Ghogare decided on 21.05.2015

9. We have carefully considered these cases in the light of following judgments of the Hon'ble Supreme Court and this Commission:

10. The main issues which arise for our consideration in these cases are:

Whether the locker holders of bank are customers of the Banks and satisfy the definition of Consumer(s) under the provisions of Consumer Protection Act.
Whether there was any deficiency in service on the part of the Bank in not taking adequate security measures for the protection of the lockers of complainant(s) leading to breaking open of such lockers of complainants resulting in theft / robbery of contents of the lockers of complainants, thereby causing financial loss to the complainants.
If answer to ( b) above is in the affirmative, can compensation be awarded by the Consumer Commission(s) for such proven deficiency in service apart from the relief for loss actually suffered.
If answer to ( b) above is in the affirmative, whether the complainants ( locker holders) are entitled to claim the value of articles lost from such lockers from the bank.
If answer to ( d) above is in the affirmative, whether such assessment of loss suffered can be done by Consumer Commission(s) in a summary proceedings under the provisions of Consumer Protection Act or such aspects have to be relegated to a civil court.
Whether in the present case State Commission was justified in enhancing the compensation amount beyond what was claimed by the complainants in their complaint in an appeal filed by the OP-Bank.

11. Issue (a ) RP/2281/2023 and connected RPs Page 45 of 68 a. The OP-Bank had contended that the consumer complaints) filed by the complainant(s) is not maintainable as the complainant(s) is not a consumer as holders of the safe deposit vault ( locker) and there is no service provider- customer relationship between the locker holder and the Bank. Both the District Commission and State Commission have concurrently held that the complainant(s) as locker holders are consumers under the provisions of Consumer Protection Act. This Commission in Mahendra Kumar Khard ( supra) and Union Bank of India ( supra) considered this issue at length in the light of the judgment of the Hon'ble Supreme Court in Amitabh Das Gupta ( supra) and held that `hiring of locker by a customer from the Bank is clearly a service provided by the bank for safe keeping of valuables in lockers for which it charges rent. The consideration paid by a person hiring a locker is therefore charges for the safe keeping of his valuables inside the locker and therefore is a service rendered by the Bank. An obligation is cast on the Bank to ensure the safety of the Bank lockers and their accessibility which is a service of safe custody. Extract of relevant paras of this Commission's judgment in Union Bank of India ( supra ) is reproduced below:

24. All the Complainants/Appellants have entered into a Memorandum of Letting of Safe with the bank and copies of the respective Memorandums have been appended alongwith the Appeals filed by the bank. The same discloses the letting out of the lockers on an annual rent of Rs. 1770% and the relationship being described on that as a lesser and lessee. The terms .& conditions of letting out are on record with a caveat that the Safe Deposit Vault is a separate department of the Bank having no connection with the monetory dealing of customers in the other departments of the Bank. It has been categorically stated that the relationship of the customer is that of a lessee and RP/2281/2023 and connected RPs Page 46 of 68 lessor and not that of a banker and a customer. This issue on identical lines was contested before this Commission in the case of Mahendra Kumar Khard (Supra) where also the Memorandum of letting of safe with the Central Bank of India was almost similarly worded. This Commission after analysing the provisions as well as the arguments advanced, held in paragraphs 32 to 36 as follows:
Commencing with the arguments advanced on the agreement it is correct that the terms of agreement use the words lessor and lessee for describing the contractual relationship between the parties. A lessor is understood to be a person who grants a lease whereas a lessee is a person to whom a lease is granted. This meaning is attached more commonly when a person rents a house or a piece of land or any other immovable property for a certain time and on certain terms and conditions. A lease ordinarily understood is a grant for any tenements at a fixed rent for a definite time with terms and conditions that govern such relationship. The agreement in the present case in clause 14 describes the connect between the Complainants and the Bank where the Bank is the renter of the safe. The question is can the nature of the relationship as understood and under the agreement be drawn within the definition of the Consumer Protection Act 1986, given the meaning of the word consumer and services. A perusal of Section 2(d)(ii) enumerates the definition of a consumer meaning a person who hires or avails of any services for a consideration that has been paid, and includes the beneficiary of such services other than the person who has hired or availed of the services, but does not include a person who avails of such services for any commercial purpose.
In the instant case, the services are of hiring a locker in the safe deposit vault maintained by the Bank. This is in the nature of "business to consumer" on a consideration annually paid as locker rental. The nature of the facility within the Bank is controlled by banking regulations which includes the circulars issued by the Reserve Bank of India from time to time. The services of providing RP/2281/2023 and connected RPs Page 47 of 68 lockers of safe custody have been subject matter of notifications issued under the Banking Regulation Act 1949. One such circular was issued containing guidelines in respect of allotment of lockers and its regulations on 17.04.2007. Thus, the operation of lockers and its hiring is governed by intervening statutory circulars and guidelines issued by the Reserve Bank of India under the provisions of the Bank Regulation Act 1949.
35. After the decision in the case of Amitabh Dasgupta (supra), the Reserve Bank of India issued circular dated 18.08.2021 where paragraph 7.2 enlists a liability imposed on Banks arising from unforeseen events like burglary in the present case.

The same is extracted hereinunder:

"7.2 Liability of banks arising from events like fire, theft, burglary, dacoity, robbery, building collapse or in case of fraud committed by the employees of the bank.
It is the responsibility of banks to take all steps for the safety and security of the premises in which the safe deposit vaults are housed. It has the responsibility to ensure that incidents like fire, theft/ burglary/ robbery, dacoity, building collapse do not occur in the bank's premises due to its own shortcomings, negligence and by any act of omission/commission. As banks cannot claim that they bear no liability towards their customers for loss of contents of the locker, in instances where loss of contents of locker are due to incidents mentioned above or attributable to fraud committed by its employee(s), the banks' liability shall be for an amount equivalent to one hundred times the prevailing annual rent of the safe deposit locker.'
36. The service on hire is of a description as defined under Section 2(o) of the 1986 Act that categorically recites that it means service of "any" description which is made RP/2281/2023 and connected RPs Page 48 of 68 "4.
available to potential users and includes, "but not limited to" the provision 'of facilities in connection with banking, financing, insurance, transport, etc. The words used in the said section are wide enough to include services of any description made available to potential users which includes banking but is not limited to the services mentioned in the said provision. Clause 14 of the terms and conditions of the locker hiring memorandum involved in the present case does recite that the connection would be not that of a banker and a customer, but an agreement of the said nature cannot take away the impact of the law made by Parliament which casts a duty and imposes an obligation by creating rights to be availed of by persons, who in the present case can be potential users of the services of the hiring of lockers, which is part of the banking facilities extended by the Bank statutorily governed by the provisions of the Banking Regulation Act, 1949. The sovereign command of the legislature through the Consumer Protection Act 1986 therefore creates a jural and legal relationship if the Bank is offering a service, which it does not call banking, but is definitely a service for charges within the meaning of "any description". The agreement therefore cannot exclude the applicability of law by which the Bank is bound and which is also recognized under the Banking Regulation Act, 1949 as an activity of the Bank, regulated and governed by the circulars issued by the Reserve Bank of India in terms of the 1949 Act. Thus, by any legal calculation, the hiring of a locker by a customer from the Bank is clearly a service provided by the Bank for safe keeping of valuables in lockers for which it charges rent. The consideration paid by a person hiring a locker is therefore paying charges for the safe keeping of his valuables inside the locker and therefore is a service rendered by the Bank. An obligation is cast on the Bank to ensure the safety of the Bank lockers and their accessibility which is a service of safe custody. The fact that the Bank has offered the hiring of the locker to the Complainants on payment of consideration is an admitted position and consequently this clearly amounts to the rendering of the service by the Bank as understood under the Consumer Protection Act in the light of the observations made hereinabove. "

25. The bench further relied on the ratio of the Judgment in the case of Amitabh Das Gupta (Supra) to conclude that the relationship between a bank and the account holders Would be that of a service provider and a consumer and it was again recorded as under follows:

It is thus clear that there is an obligation cast under law on the Banks to ensure the safety and security of the valuables against possible thefts and robberies. It is true that the aforesaid judgement was rendered where the Bank itself had owned the responsibility of unauthorizedly having broken the locker of a customer but while analyzing the duties and responsibilities of the Bank vis- a-vis third party as well, the Apex Court made the observations quoted hereinabove, which are binding and the ratio thereof can be safely applied on the facts of the present case.
The decision in the case of Amitabh Dasgupta (Supra) also holds that the relationship between the Bank and the locker holders will that be of a service provider and consumer. This issue also therefore no longer remains res Integra and stands answered against the Bank."

26. Consequently, the arguments raised on behalf of the bank having been answered as quoted above does not require any further elaboration. The contention raised by the Learned Counsel for the Bank regarding the status of relationship is, therefore, accordingly rejected.

12. In view of the foregoing, we hold that complainants as locker holders of the OP bank and having paid consideration in terms of annual rent, are the consumers under the provisions of Consumer Protection Act, hence the complaints are maintainable.

13 Issue (b) The complainants have alleged that said theft had occurred due to sheer negligence of the bank, as the bank had not taken any safety RP/2281/2023 and connected RPs Page 50 of 68 precautions. The branch had not installed any CCTV camera in and around the lockers of the bank and there was no alarm as well as lack of security guards due to which theft had taken place. The complainant further alleged that due to lack of safety measures, the complainant had suffered huge monetary loss due to theft of valuables kept in the locker and the same had taken place due to deficiency in service rendered by the bank, hence the Bank is responsible for the loss suffered to the complainant. The Bank denied that there was any deficiency in service as alleged by the complainant. The bank had also contended that the complainant was aware of the errors / deficiencies in the branch at the time of taking the locker and had accepted the same, therefore, now cannot raise issues with respect to such deficiencies. In the present case, both the Fora below after taking note of the evidence before it, have come to the concurrent findings of deficiency in service on the part of OP Bank. In this regard, extract of relevant paras of the order of the State Commission is reproduced below:

4. ....After appreciating evidence placed on record, the learned District Commission has come to the conclusion that the opponent namely Nashik District Central Co-Operative Bank Limited had not taken necessary safety measures for the safety of the lockers kept by it. The learned District Commission also come to the conclusion that due to lack of safety measures on the part of the opponent, the theft of gold ornaments weighing 430 gms of the complainant had taken place and the same amounts to deficiency in service on the part of the opponent Nashik District Central Co-Operative Bank Limited.

Accordingly the learned District Commission, Nashik allowed the complaint and directed the opponent nos. 1 to 3 to pay value of 430 gms of gold as per market rate @12%. The learned District Commission also awarded compensation of Rs.25, 000% towards mental and physical harassment and Rs. 10,0001-towards costs of the litigation.

9. Though the complainant has not been able to establish positive evidence regarding value of the gold ornaments kept in RP/2281/2023 and connected RPs Page 510168 the locker, it is crystal clear that there was gross negligence on the part of Ranwad branch of Nashik District Central Co- Operative Bank Limited, in as much as the bank had not taken mandatory and sufficient steps regarding the safety of the locker. It is difficult to imagine that the bank was operating the lockers with minimum safeguards of maintaining the security guards and with minimum installation of CCTV, due to which, not only the present complainant, but also the other locker owners were put to not only hardship but also to huge monetary loss.

14. As has been held by the Hon'ble Supreme Court in catena of judgments' that revisional jurisdiction of the National Commission is extremely limited, it should be exercised only in cases as contemplated within the parameters specified in the provision i.e. when State Commission had exercised a jurisdiction not vested in it by law or had failed to exercise jurisdiction so vested or had acted in the exercise of its jurisdiction so vested or had acted in the exercise of its jurisdiction illegally or with material irregularity. It is only when such findings are found to be against any provisions of law or against the pleadings or evidence or are found to be wholly perverse, a case for interference may call for at the second appellate (revisional) jurisdiction. We have looked into the evidence placed before the Fora below with respect to deficiency in service on the part of the Bank in not taking adequate measures for the safety of the lockers, which led to the theft of the contents of the lockers and consequent loss to the complainants. State Commission has given clear findings of gross negligence on the part of the Bank, observing that Bank had not taken mandatory and sufficient steps 1 Ruby (Chandra) Dutta vs. United India Insurance Co. Ltd. ((2011) 11 SCC 269, Sunil Kumar Maity vs. State Bank of India and Ors. (2022) SCC Online SC 77, Lourdes Society Snehanjali Girls Hostel and Another Vs. H & R Johnson (India ) Limited and Ors, (2016) 8 SCC 286, T. Ramalingeswara Rao (Dead) Through Legal Representatives and Anr. Vs. N. Madhava Rao and Ors. (2019) 4 SCC 608, Rajiv Shukla Vs. Gold Rush Sales and Services Limited and Anr. (2022) 9 SCC 31 RP/2281/2023 and connected RPs Page 52 of 68 regarding the safety of the lockers. There were not sufficient safeguards in terms of security guards and CCTV cameras etc. State Commission has given a well reasoned order and we do find any reason to interfere with its findings.

There is no illegality or material irregularity in the order of the State Commission.

After careful consideration of the facts and circumstances of the case, we are in agreement with the concurrent findings of District Commission and State Commission about the deficiency in service on the part of the OP Bank about not taking the reasonable measures for ensuring the safety of lockers which led to the breaking open of the locker by the miscreants leading to theft of contents of locker and resultant loss to the complainants. Hence, we answer this issue in the affirmative and hold that the OP bank was deficient in service.

Issue (c) Having decided the issue ( b) in the affirmative, the question now arises is what are the reliefs which the consumer Commission can grant against the OP, against whom the deficiency in service is established. In this regard, relevant provisions of Section 14 of Consumer Protection Act, 1986 are reproduced below ( section 39 of the Consumer Protection act, 2019 have similar provisions )

14. Finding of the District Forum. -- (1) If, after the proceeding conducted under section 13, the District Forum is satisfied that the goods complained against suffer from any of the defects specified in the complaint or that any of the allegations contained in the complaint about the services are proved, it shall issue an order to the opposite party directing him to do one or more of the following things, namely:--

Il l X«XXx xxxxx to return to the complainant the price, or, as the case may be, the charges paid by the complainant;
to pay such amount as may be awarded by it as compensation to the consumer for any loss or injury suffered by the consumer due to the negligence of the opposite party.
Provided that the District Forum shall have the power to grant punitive damages in such circumstances as it deems fit; XKrax xxxxx xxxxx xxxxx (ha) xxxxx (hb) xxxxx (hc)xxxxx to provide for adequate costs to parties.

It was held by Hon'ble Supreme Court in Wg. Cdr. Arifur Rahman Khan and Aleya Sultana and Ors. vs DLF Southern Homes Pvt. Ltd. & Ors. (2020) 16 SCC 512 "......The word "Compensation" is of a very vide connotation. It may constitute actual loss or expected loss and may extend to compensation for physical, mental or even emotional suffering, insult or injury or loss. The provisions of Consumer Protection Act enable a consumer to claim and empower the commission to redress any injustice done"

It was held by Hon'ble Supreme Court in Singh v. Healing Touch Hospital, (2000) 7 SCC 668
12. While quantifying. damages, Consumer Forums are required to make an attempt to serve the ends of justice so that compensation is awarded, in an established case, which not only serves the purpose of recompensing the individual, but which also at the same time, aims to bring about a qualitative change in the attitude of the service provider. Indeed, calculation of damages depends on the facts and circumstances of each case. No hard and fast rule can be laid down for universal application. While awarding compensation, a Consumer Forum has to take into account all relevant factors and assess RP/2281/2023 and connected RPs Page 54 of 68 compensation on the basis of accepted legal principles, on moderation. It is for the consumer forum to grant compensation to the extent it finds it reasonable, fair and proper in the facts and circumstances of a given case according to the established judicial standards where the claimant is able to establish his charge.
It was held by Hon'ble Supreme Court in Magma Fincorp Ltd. v. Rajesh Kumar Tiwari, (2020) 10 SCC 399 "59. Where, however, the damages caused by the breach are severe and extensive, the party in breach may be required to pay to the party not in breach, such damages as would restore the position of the party not in breach, to the position before the breach occurred.
60. Apart from compensatory damages, an adjudicating authority may impose on the party in breach, punitive damages or nominal damages. The Hon'ble Supreme Court in its recent judgment in Parsvnath Developers Ltd. Vs. Mohit Khirbat and Connected matters - 2026 SCC OnLine SC 281 observed as follows:
10. The jurisdiction of the consumer fora is traceable not merely to the contractual terms agreed between the parties but to the statute itself. Sections 12 and 22 of the Act empower the consumer fora, including the NCDRC to adjudicate complaints relating to deficiency in service and to grant appropriate reliefs. Section 22 expressly incorporates the powers under Sections 12, 13 and 14, thereby enabling the NCDRC to issue directions and award compensation for loss or injury caused to a consumer....

xxxxx

18. ......The power of the consumer fora to grant just and reasonable compensation for deficiency in ' service is traceable to the statute and cannot be curtailed by RP/2281/2023 and connected RPs Page 55 of 68 contractual terms which operate to the detriment of the consumer. The award therefore represents a legitimate and permissible exercise of statutory jurisdiction.

xxxxx The expansive understanding of "compensation" under the Act was authoritatively explained in Lucknow Development Authority (supra). Subsequent decisions, including Chief Administrator, H.U.D.A. and another v. Shakuntla Devi ( 2017) 2 SCC 301 and DLF Homes Panchkula Pvt Ltd. v. D.S. Dhanda Etc. Etc. AIR 2019 SC 3218 reiterate that compensation must be fair, reasonable, and commensurate with the loss or injury suffered. The consumer fora must analyse the factual matrix and cannot mechanically restrict compensation to strict financial calculations alone.

The jurisprudence that emerges is clear :

compensation under the Act is remedial and protective in character. Detailed mathematical ascertainment of market decline is not a sine qua non; what is required is that the award be just, reasonable and proportionate to the delay, deprivation and hardship established on record.
21. Hence we hold that in cases where deficiency in service on the part of service provider is proved, as is the present case(s), the Consumer Commission has the power to award compensation for the mental agony and injury suffered by the complainant on account of deficiency in service on the part of the OPs, apart from the relief for the financial loss actually suffered.

.Hence, in the present case, both the Fora below were justified in awarding compensation for mental agony and injury on account of proven deficiency in service on the part of the OP bank.

. Issue (d), (e) and ( f ).

Now, we come to the most important issue of entitlement of complainants ( locker holders ) to claim the value of articles lost from such lockers from the bank in cases where deficiency in service on the part of bank stand proved. It is the standard defence of the bank in such cases and same are the Bank's contentions in the present case, that bank does not have any control or knowledge regarding the valuables kept in the lockers. OP bank in their reply before the District Commission stated as follows:

Each locker has two keys out of which one key is given to the locker holder and one key is with the concerned branch officer and the locker cannot be opened without both these keys. When a locker holder comes to the bank to deposit or withdraw goods, he first mentions his name and time in a separate register (locker register) and then the branch officer takes his nearest key to the locker and goes to the locker room with the locker holder and the manager attaches the key to the locker. leaves and thereafter the locker holder opens the locker with his key, at that time none of the branch manager is present in the locker room and therefore the branch manager or the staff have no knowledge of what items have been kept or removed by the locker holders or not kept or removed. In such a situation no one including the branch manager has any knowledge of what is in the locker or what is not there and therefore the management has no control over the items in the locker or the transactions related to the locker...
It is true that in locker hiring in a bank, the bank / its officials have no knowledge of the contents of the locker. But considering the judicial pronouncements that hiring of locker amounts to availing of services by the customer / consumer and if the bank has failed to adequately secure such locker, resulting in loss to such locker holder, the bank is liable to compensate the locker holder for such losses. In Amitabh Das Gupta ( supra), Hon'ble Supreme Court held that bank owes an independent duty of care to its customers with respect to diligent management of locker separate from its RP/2281/2023 and connected RPs Page 57 of 68 contents. This includes ensuring proper functioning of locker system, guarding against the unauthorised access to locker and providing appropriate safeguards against theft and robbery. This duty of care is to be exercised irrespective of application of laws of bailment or any other legal liability regarding contents of locker. Banks as custodians of public property cannot leave customers in lurch merely by claiming ignorance of contents of lockers.
Hon'ble Supreme Court in this case also observed as under:
20. In such a situation, the banks cannot wash off their hands and claim that they bear no liability towards their customers for the operation of the locker. The very purpose for which the customer avails of the locker hiring facility is so that they may rest assured that their assets are being properly taken care . of. Such actions of the banks would not only violate the relevant provisions of the Consumer Protection Act, but also damage investor confidence and harm our reputation as an emerging economy.

c. However, the Hon'ble Court also observed that this in turn requires factual findings on whether the bank had knowledge of contents of locker or whether locker holder had prepared any receipt or inventory of articles placed inside locker or was otherwise able to prove particulars of items deposited in locker. Hon'ble Court also observed that these questions cannot be adjudicated upon in the course of proceedings before consumer Fora, these aspects must be evaluated by Civil Court upon appreciation of evidence led by parties. No doubt such a task before the locker-holder is an extremely different one, if not impossible, whether he has to do before the consumer RP/2281/2023 and connected RPs Page 58 of 68 Fora or before a Civil Court. The adjudication on the contents of the locker would similarly be an extremely difficult task even by the Civil Court since the contends of a locker are exclusively known only to the locker-holder. Here it is important to note that what the locker-holder has to prove is the contents of locker at the time of incident and not necessarily the ownership, although the later may be helpful for him to prove the former. It is a common practice in Indian society to have gold / silver/ other valuables items inherited by them from their forefather and / or self acquired, for which they may not have the requisite ownership document / proof and / or purchase bills etc. Moreover, the locker holder does not necessarily keep his own valuable articles in such locker but also of those belonging to his other family members, including those belonging to the spouse, children, children's spouse, siblings etc. Hence, to claim compensation for loss actually suffered, the locker holder has to strictly speaking, prove the contents of such locker at the time of incident and not simply the ownership. If he is able to successfully prove with reliable and cogent evidence / documents the contents of locker at the time of incident, he is entitled to claim compensation for actual loss, even if all such contents may not be in his ownership and may belong to some of his family members.

Conversely, even if the locker-holder is able to prove the ownership of some such valuables but not able to prove that such valuables were indeed inside the locker at .the time of incident, the bank can rightfully deny its liability by taking a plea that such valuables though proved in terms of ownership ( e.g. RP/2281/2023 and connected RPs Page 59 of 68 purchase bills etc) may not have been kept inside such locker at the time of incident.

d. Hence, considering the prevailing locker system, under which only the locker-holder is privy to its contents and bank has no knowledge of its contents, and is not even supposed to have such knowledge and locker-

holder is free to keep --in / take out valuables from such locker at any time without any disclosure of items kept in or taken out on each operation of such locker, the entire onus of proving the contents of such locker at the time of incident and its value rests on the locker-holder / complainant, an extremely difficult task indeed, whether he has to do before a consumer commission or a civil court. This further adds to the mental agony of such locker-holder / complainant, who has suffered loss on account of theft of contents of his locker. Hence, keeping in view the law laid down by the Hon'ble Supreme Court in Amitabh Das Gupta ( supra) that these questions ( contents of locker) cannot be adjudicated upon in the course of proceedings before Consumer Fora and these'aspects must be evaluated by the Civil Court upon application of evidence led by parties, we hold that notwithstanding that complainants / locker-holders are entitled to compensation for actual loss of contents of locker on account of proved deficiency in service on the part of the OP-Bank, they will have to prove actual loss suffered before a Civil Court by leading appropriate evidence and consumer commission will not be able to evaluate such evidence in view of clear directions of Hon'ble Supreme Court in Amitabh Das Gupta ( supra). However, this will not take away the power of consumer RP/2281/2023 and connected RPs Page 60 of 68 ` , W;

commission to award compensation for mental agony / injury and / or litigation cost. Hence, in the present case, we are of the considered view that District Commission could not have assessed the loss of contents of locker and State Commission was justified in modifying the District Commission's order on this aspect and observing that in the absence of positive evidence regarding total value of gold, for which detailed evidence is necessary, the Complainant is entitled only for compensation towards mental and physical harassment and not the price of gold, as directed by the District Commission. However, State Commission has not specifically stated in its order that Complainants are free to approach the Civil Court with respect to compensation for actual loss of locker contents. Hence, while upholding the State Commission's order on this aspect, we would like to specifically state that Complainants have the liberty to approach the appropriate civil Court for claiming compensation of actual loss suffered and also claim benefit of limitation for the period for which the consumer case proceedings remained pending with District Commission / State Commission / National Commission, since the date of filing the complaint.

23. As regards State Commission's decision to enhance the compensation for mental agony and harassment from Rs.25,000/- as granted by District Commission to Rs.3.00 lakhs and litigation cost from Rs.10,000/- as granted by the District Commission to Rs.50,000//-, we are of the considered view that in view of peculiar facts of the case, where the complainants are under great mental stress and for the last more than 10 years and have been made to fight RP/2281/2023 and connected RPs Page 61of 68 a legal battle at three levels District Commission / State Commission and now at National Commission level and have now been relegated to civil court, compensation of Rs.3.00 lakhs and litigation cost of Rs.50,000/- are fully justified.

The contentions of OP Bank is that such compensation I costs granted are beyond what have been sought in the complaint are not valid, as the prayer in the complaint have to be read together in totality and not in isolation.

No doubt, in the complaint, the complainant asked for compensation of Rs.50,000/- for mental agony and Rs.10,000/- towards costs, it was in addition to claim of Rs.11,46,775/- with interest @ 18% from 25.08.2015, but the same has been disallowed by the State Commission. Moreover, prayer ( f) in the complaint also states ' other justifiable order should be passed in favour of complainant'. Hence in the given facts of the case, State Commission while not allowing prayer ( b) of complaint ( Rs.11,46,775/- with 18% interest) was justified in enhancing the compensation for mental agony to Rs.3.00 lakhs and cost to Rs.50,000/-.

It may be noted that order of District Commission was not challenged by the complainant but by the OP Bank. Hence the complainant did not approach the State Commission for enhancement of compensation but were made to defend the District Commission's order. It is the State Commission which on its own, have in the totality of facts, disallowed compensation towards actual loss in terms of value of 430 grams of gold awarded by the District Commission but somewhat enhanced the compensation towards RP/2281/2023 and connected RPs Page 62 of 68 mental agony and cost. We find no illegality or material irregularity in the order of the State Commission in this regard.

26. in view of foregoing, we uphold the order of the State Commission with liberty-to_the complainants to approach the appropriate Civil Court for =claiming compensation for actual loss of valuables kept in the locker. They -may also claim benefit.of limitation period for the -period -their 'cases remained -pending with consumer commissions. Hence, a.1! the 57 RPs covered under this order, .28 filed by complainants and 29 filed by the Bank as -detailed in Annexure -- A are-dismissed.
