1. This hearing has been done through hybrid mode (physical and virtual hearing).
2. Petitioner No. 1 is a director in the following three companies:-
(i) Saffron Marketing India Private Limited;
(ii) Ginesis Combines Media Private Limited; and
(iii) Pritpal Kalsi Film Corporation Private Limited
3. Petitioner No.2 is a director in the following five companies:-
(i) Saffron Marketing India Private Limited;
(ii) Ginesis Combines Media Private Limited;
(iii) Icons Infraprop Private Limited;
(iv) Five Rivers Productions Private Limited; and
(v) Saffron Magazines and Books Private Limited.
4. Out of these companies, it is submitted that Saffron Marketing India Private Limited and Five Rivers Productions Private Limited are active companies. Both companies are located in Delhi and were incorporated in Signature Not Verified Digitally Signed By:PRATHIBA M SINGH Signing Date:03.02.2021 11:06 Signature Not Verified Digitally Signed By:DINESH SINGH NAYAL Signing Date:03.02.2021 11:47:19 2000 and 2012, respectively. Ginesis Combines Media Private Limited was struck off from the Register of Companies due to non-filing of its annual returns and balance sheets, leading to the disqualification of the Petitioners under Section 164(2) of the Companies Act, 2013 and deactivation of their DIN/DSC. Since the Petitioners have been disqualified prior to 7th May, 2018, following the judgment of a ld. Single Judge of this Court in Mukut Pathak & Ors. v. Union of India & Ors., 265 (2019) DLT 506, disqualification of the Petitioners qua the said active companies is set aside. The DINs/DSCs of the Petitioners are directed to be reactivated within a week.
5. Insofar as Saffron Marketing India Private Limited is concerned, the same has already been restored by the NCLT vide order dated 19th March, 2020. Thus, the DINs/DSCs of the Petitioners be also reactivated in respect of the said companies.
6. With these observations, the petition is disposed of. All pending applications are also disposed of.
