1. In this case, after hearing the learned Counsel for the parties, we had tentatively allowed this writ petition with reasons to be dictated separately. Thereafter, however, on studying the file we noticed that the DOP&T OM dated 27 March 2012 on which the petitioner placed reliance specifically restricts its application to civilian government servants. The petitioner is not a civilian government servant. The judgment of the Division Bench of this Court in Krishan Singh v UOI1 which is cited by the petitioner specifically notes that the instructions in that case did not distinguish between civilian and combatised personnel.
2. We, therefore, were constrained to re-examine the matter, and relisted it.
