Relevant Facts emerging during Hearing:
The following were present Appellant: Mr. Santosh K. Kabadi through videoconferencing Respondent: Mr. S S Negi, CPIO's representative through videoconferencing.
The appellant stated that he had not been provided proper information in response to his RTI application dated 27/12/2010. He added that the CPIO had advised that the relevant records have been eaten by white ants/termites but he is not satisfied with this response. He further stated that he has served in the postal department for almost three years but they had terminated his employment without assigning any reasons. The CPIO's representative stated that the information on record has been furnished to the appellant. He explained that the record retention period for acquaintance roll is 6 years after which they are weeded out, however, the muster rolls are permanent records but unfortunately they have been eaten away by white ants/termites.
Decision Notice:
After hearing submissions of both the parties the Commission directs the CPIO to permit the appellant to inspect the record(s) related to his RTI dated 27/12/2010 to satisfy himself that all information as available has been provided to him. The CPIO should fix a mutually convenient time and date with him for the inspection and also permit him to take photocopies there from free of cost up to 50 pages. In case some records have been weeded out/eaten away by white ants/termites a declaration to the effect along with a copy of record retention policy should be furnished to the appellant by 20/09/2012.
The appeal is disposed of accordingly.
