The petitioners have prayed for the issuance of a writ in the nature of mandamus for quashing the certificate of Haryana Teacher Eligibility Test (hereinafter referred to as the "HTET") qua the validity showing upto 01.12.2016 and further for a direction to the respondents to grant validity of HTET certificate issued to them for 5 years from the date of issuance of the certificate.
In brief, the petitioners appeared in the HTET held on 05/06.11.2011. The result of the said test was declared on 01.12.2011 and the petitioners were declared not qualified for the reason that they had failed to secure minimum marks prescribed. However, the result was challenged by some similarly situated persons in CWP No.17410 of 2012, which was allowed by this Court on 08.01.21013 and the respondents were directed to give relaxation to the petitioners therein and revise the result accordingly. The petitioners also approached the Board to grant them relaxation and revise their result. Though the petitioners have been granted relaxation and declared 1 of 2 ::: Downloaded on - 07-10-2018 20:50:05 ::: CWP No.22842 of 2018 [2] ***** "qualified" in the HTET but validity of the certificates issued to them have been shown upto 01.12.2016.
Counsel for the petitioners has submitted that in exactly similar circumstances, while allowing CWP No.16496 of 2017, this Court had issued directions to the respondents to issue HTET certificates to the petitioners therein, valid for a period of five years w.e.f. 31.01.2017. It is submitted that the case of the petitioners is squarely covered with the judgment rendered by this Court in the case of Kuldeep Singh and others vs. State of Haryana and others, CWP No.16496 of 2017, decided on 08.05.2018.
However, it is not denied by the counsel for the petitioners that the petitioners had already approached the respondents in regard to their grievance(s) vide Annexures P-4 and P-5, on which final decision has not been taken by the respondents so far.
Keeping in view the aforesaid facts and circumstances, the present writ petition is hereby dismissed being premature. However, the respondents are directed to consider and decide the representations (Annexure P-4 and P-5) of the petitioners in terms of the decision rendered by this Court in Kuldeep Singh's case (supra) within a period of one month from the date of receipt of a certified copy of this order.
