3. The Respondent has been served through ld. Counsel. Mr. Kapoor, ld. Counsel submits that the Respondent has also been served through speed- post and the tracking report would be placed on record.

4. It is seen that the application under Order IX Rule 13 CPC was allowed by the Trial Court vide the impugned order dated 15th October, 2019, after condoning the delay under Section 5 of the Limitation Act, 1963 and the decree which was passed in favour of the Petitioner was set aside.

5. For the last two dates, the Court has been attempting to serve the Respondent. The Registry's report shows that the Mr. S.C. Rana, ld. Counsel for the Respondent in the Trial Court has been served.

6. Accordingly, list this matter for hearing on 17th September, 2021.
