(1)The Adjudicating Officer shall, after the enquiry under sub-section (2) of section 30, decide whether there is contravention of any of the provisions of this Act or rules made thereunder or of any order issued thereunder or any of the conditions of the licence and any such person, on being found guilty by the Adjudicating Officer, shall be liable to such penalty not exceeding,-(a)five thousand rupees, if the value of any such fish seed is one thousand rupees or less;(b)five times the value of the fish seed, if the value of any such fish seed is more than one thousand rupees;(c)in the event of second offence or such person having been previously fined for an offence under this section, impose a fine which shall not be less than ten thousand rupees and which may extend to twenty five thousand rupees;(d)in the event of subsequent offence after second offence, if hatchery or fish seed farm, agency, association, firm or company, blacklist the hatchery or fish seed farm, agency, association, firm or company in the manner as may be prescribed.
