Section 9 in All India Services (Death-Cum-Retirement Benefits) Rules, 1958

9. Counting of periods of leave as qualifying service.

- [(1) All periods of leave with allowances and extraordinary leave granted on the basis of medical certificate shall count as qualifying service:Provided that the Central Government may, in any case in which it is satisfied that the extraordinary leave was taken by a member of the Service for any cause beyond the control of such member or for prosecuting higher [studies] [Substituted vide DP &AR Notification No. 25011/22/82-AIS(II) dated 16.7.83 (GSR No. 557 dated 30.7.83)] in the field of science, technology, finance, economics, law or other social sciences, direct that such extraordinary leave shall be counted as qualifying service.]
(2)Leave granted by foreign employer to a member of the Service while on foreign service out of India under sub-rule (1) of rule 27 of the Leave Rule shall be treated as leave and not as duty and shall qualify for pension subject to the provision of sub-rule(1).
