CMP (M) No. 604 of 2022 and 2297 of 2023 Applicants/appellants have filed CMP (M) No. 604 of 2022 for substitution of deceased respondent No. 3 Surjan Singh through his legal heirs mentioned in para 2 of this application (CMP (M) No. 604 of 2022) by indicating that Bishan Singh (father), Ashima (wife), Ambika (daughter) and Vipin Kumar (son) were surviving legal heirs of late Sh. Surjan Singh.
After issuing summons to proposed legal heirs, certain information surfaced on record and now, on the basis of such information and also by inquiring the matter, appellants/applicants have claimed that Bishan Singh (father) and Vipin Kumar (son) have also expired and another son of Surjan Singh, namely, Nitin Thakur son of Surjan Singh is surviving legal heir alongwith his mother Ashima and sister Abmika and as on date surviving legal heirs/legal representatives of Surjan Singh are Ashima (wife), Ambika ::: Downloaded on - 05/04/2023 20:38:21 :::CIS (daughter) and Nitin Thakur (son). given in para 2 of CMP No. 2297 of 2023.
In aforesaid facts and circumstances now notices are to be issued in these applications to surviving legal representatives of late Sh. Surjan Singh, as mentioned in para 2 of CMP No. 2297 of 2023. Accordingly, on taking steps within three days, notices returnable within four weeks, be issued to proposed respondents/legal heirs of late Sh. Surjan Singh, mentioned in para 2 of CMP No. 2297 of 2023.
