In the present petition, letter dated 7-9-1998 of the Deputy Town Planner, Surendranagar has been impugned, whereby the petitioners have been directed to make a provision for a common plot out of Final Plot No.66 admeasuring 14638 Sq.Mts. allotted to them in lieu of their original plot. Mr.J.D.Ajmera,learned counsel for the petitioners submits that as per Town Planning Scheme No.1 of Surendranagar sanctioned by the State Government on 5-11-1990 which came into force with effect from 18-12-1990, (a copy of which is annexed as Annexure R-1 to the further affidavit-in-reply filed by the respondents Nos.1 and 2), there is a provision to reserve an area admeasuring 333 sq.mts. per Hectare for a common plot whereas the respondents have reserved an area in excess of this.
There is no dispute between the parties that some area has to be reserved for a common plot. The controversy is, how much area is to be so reserved.
Ms.Archana Rawal,learned Assistant Government Pleader, seeks time to obtain instructions in order to clarify the position. List the matter tomorrow i.e. on 30 12-2008.
