The RTI application dated 7.5.10 was filed by the Applicant with the PIO, AIR, Jaipur seeking information against 3 points including copy of the attendance register and pay bills and absentee statement of Mr. S.K. Vyas for the period 5.5.08 to 30.4.10 when he was working as Administrative Officer. The PIO replied on 24.5.10 providing point wise information. Not satisfied with this reply the Applicant filed a complaint with the Commission on 23.6.10 seeking details of the attendance and the absentee statement .
Decision
2. During the hearing the Respondent submitted that no attendance register of any Gazetted Officer is maintained in any AIR or Doordarshan office. . As for information against point 3, according to the Respondent absentee statement is prepared only when the official is absent for a long period of time or is on a deputation and substituted by another officer, as per rule No.67 of Central Government Account (Receipt & Payment) Rules 1983. The Respondent further added that Mr. Vyas had never gone on any long leave and hence there is no absentee statement against his name. After hearing the Respondent, the Commission directs the PIO to provide an affidavit to the Commission with a copy to the Complainant affirming the fact that neither the attendance register nor the absentee statement is available with the Public Authority and giving reasons for their nonavailability. The affidavit should reach the Commission by 25th December, 2010.
