The instant petition has been filed under Section 439 Cr.P.C. for grant of regular/interim bail to the petitioner in FIR No.127 dated 17.09.2015, under Sections 363, 366, 376-D, 120-B, 328 of Indian Penal Code, Sections 4, 6 of POCSO Act and Sections 3, 4 of SC & ST Act, registered at Police Station Kharar, District SAS Nagar (Mohali).
In brief, the facts of the case are that the aforesaid FIR came be registered on the statement of Gurmeet Singh that petitioner Amanpreet Singh son of Avtar Singh and Tinka son of Lakhvir Singh had committed a wrong done with his daughter. Pursuant to the FIR, the petitioner was arrested and investigation was done. His bail application has been dismissed, on account of the fact that he is facing trial for the commission of 1 of 2 offence of gang rape of the prosecutrix, who is a minor.
The only plea made at the present moment seeking grant of regular/interim bail is to attend the marriage of his brother, which is fixed for 27.09.2017.
I have heard counsel for the petitioner and this court is not inclined to grant him the relief, as sought. The petitioner herein is facing trial for a heinous crime that has been committed i.e. being involved in the crime of gang rape of a minor. The wedding ceremony of his brother has been fixed for 27.09.2017 and the petitioner being brother is not required to participate in any of the religious ceremony, to warrant grant of regular/interim bail.
