The said clarification was with regard to API score between 5th March, 2010 and issuance of AICTE Regulations 2012, which came about on 8th November, 2012. The clarification that is issued is that, API is to be relaxed for a period of 03 years only till 07.11.2015, from the date of issue of AICTE Regulations, 2012 in the Official Gazette. These clarifications issued by the AICTE do not bear consideration in the impugned order.

13. The learned counsel appearing for the petitioners also placed on record a subsequent communication issued by the AICTE dated 05-08-2021, which is by way of a public notice. The notice reads as follows:
