SHRI L.K. ADVANI: Contempt cases are not mentioned here. They are of a separate knowledge.

SHRI SOMNATH CHATTERJEE : Have they not referred to it?

SHRI L.K. ADVANI: No. श्री मोहन सिंह : गवर्नर की चिट्ठी में है। श्री लाल कृष्ण आडवाणी: है, वह केस तो पेंडिंग है।

But otherwise, he would not say `design'. Normally encroachments have not been removed but because he is fully aware of the whole position, therefore, he used the word `design'. And, I regard this an important judgment.

SHRI SOMNATH CHATTERJEE : Can we have that endorsement? You are referring to something which we do not know.

SHRI L.K. ADVANI: I am not quoting from it.

SHRI SOMNATH CHATTERJEE : You are referring to what the hon. Rashtrapathiji has said in a file. Either you are mentioning it or quoting it. But we do not know the facts. Not that I am questioning it, but if you are relying on the hon. Rashtrapathiji's endorsement, then we should have it. Otherwise, don't refer to that thing.

SHRI L.K. ADVANI: I have no difficulty. I knew that if I were to quote anything, then I would have an obligation. I have not quoted anything. I have simply given the substance. I am paraphrasing because I am conscious that the rules bind me, the moment I quote. But as it is, the rules do not bind me.

SHRI SOMNATH CHATTERJEE : Please do not bring Rashtrapathiji.

SHRI L.K. ADVANI : All right. But there is a background. Here is a case.

SHRI SOMNATH CHATTERJEE : Has he returned it?

SHRI L.K. ADVANI : Yes. He returned it.

SHRI E. AHAMED (MANJERI): The Home Minister wanted to convey what Rashtrapathiji has said. That is also not acceptable. श्री लाल मुनी चौबे (बकसर) : २६ जनवरी को राष्ट्रपति ने बयान दिया है। उन्होंने ऐसा ही कहा है। अखबार में यह बात आई है।

(व्यवधान) श्री लाल कृष्ण आडवाणी: जिस समय हमने निर्णय लिया, उस समय हम इस बात से परचित थे कि लोक सभा में इस सरकार का बहुमत है, राज्य सभा में बहुमत नहीं है और संविधान के अनुसार इस प्रस्ताव को दोनों सदनों में पारित कराना आवश्यक है। हमने सोचा कि हम धारा ३५५ के अधीन अपने कर्तव्य की पूर्ित करें और हम अपेक्षा करते हैं कि जो शेष दल हैं, जो बिहार के बारे में चिंतित हैं, वे भी हमारा समर्थन करेंगे। मैं आर.जे.डी. की बात समझ सकता हूं, बाकी की नहीं समझ सकता कयोंकि उनकी सरकार थी और वह सरकार बरख्वास्त की गई है तो पोलीटिकली उनकी पार्टी की प्रतक़िया होना स्वाभाविक है और वह मेरी समझ में आता है। इसलिए पहले-पहले जब कांग्रेस पार्टी के महामंत्री ने तुरंत हमारे निर्णय के बाद उसका स्वागत किया तो हमको बहुत खुशी हुई। ये यहां बैठे हुए हैं।

SHRI L.K. ADVANI: That was when it was used against you.

SHRI AJIT JOGI : Naturally. We would oppose it only when we are in the Opposition.

SHRI L.K. ADVANI: I stand corrected to that extent. (Interruptions)

MR. SPEAKER: Hon. Members, please take your seats.

SHRI L.K. ADVANI: I stand corrected on this. मैं तो इतना ही कहूंगा कि इस प्रश्न पर अगर हम दलों से ऊपर होकर, दलगत दृष्िटकोण को छोड़कर, कयोंकि अगर दलगत दृष्िटकोण को देखकर कांग्रेस यह काम करेगी तो हमको कोई नुकसान नहीं होगा, हमको तो फायदा ही फायदा होगा, हमारा तो भला होगा, लेकिन उससे कुल मिलाकर बिहार को नुकसान होगा। बिहार में, वषर्ों से विकास अवरुद्ध हो गया है, बिहार में वषर्ों से लगातार इस प्रकार के हत्याकाण्ड हो रहे हैं और लगातार कमजोर वगर्ों पर इस प्रकार के प्रहार होते रहे हैं, इसके कारण सामाजिक समरसता को संकट पैदा हुआ है। इन्हीं शब्दों के साथ मैं सदन से अनुरोध करता हूं कि इस प्रस्ताव का समर्थन करें।
