obligations to its lenders or mobilise the money to complete the punch
list items.
11. Consequently, the respondent no.2, acting on behalf ... although the Independent Engineer
confirmed that the petitioner had completed major punch list items, it
recommended respondent no.1 to suspend the petitioner
have appended thereto
a list of outstanding items signed jointly by the
Independent Engineer and the Concessionaire (the
"Punch List"); provided that ... Completion of Punch List items
14.4.1 All items in the Punch List shall be completed
by the Concessionaire within 90 (ninety) days of the
date
work adverted to in the punch list;
(b). secondly, whether the delay in completion of the punch list items was
attributable to the respondent ... detail out as to what
are considered as : punch list items. The punch list items are, accordingly,
culled out below. I may only note that
were classified under three lists. List 'A' for the works to be
completed before issuance of the PCOD; List 'B' setting ... recommended issuance of the PCC
and also enclosed a punch list setting out works which required to be
completed.

facts of the present case, however, it transpired that besides the punch list
items
time thereafter to
complete the repairs of those items listed in the 'punch list'. She reiterated
that the Petitioner was at this stage ... will draw up a further list of works noted for
rectification and include them in the 'punch list'. These shall
be carried
work done by the Petitioner in
relation to the punch list items;
(e) pass ex-parte ad-interim orders in terms of prayers ... states on December 18, 2021, the
Independent Engineer had issued punch list of items to be carried out by the

Commission has allowed Rs. 3.54 crores as punch list
items. In case of items already covered the cost agreed
in PPA, allowing such expenditure ... after COD of the Project a number of
items called 'punch list items' which do not have a
direct bearing
