Passport, the Passport Officer under the
provisions of Passport Act has not to shut his eyes and to act on that.
Since the Passport applied ... made to re-issue Passport in favour of the petitioner and the
Passport Officer refused to issue the same for the reason of
'security

"6. Refusal of passports, travel documents, etc.--

passport authority shall by order in writing take a decision whether to
issue or refuse a passport, after making such inquiry
deal with issuance of passport and the
grounds on which the passport authority refuse make endorsement. It does

renewal
of the passport on the ground of pendency of the
criminal appeal.

passport. Reliance in this regard is placed by the petitioner on
Section 6 of the Passport Act to argue that the passport authority can refuse ... Section 6 of the Passport Act clearly provides
that application for grant or renewal of passport shall be refused only on
the grounds mentioned

The petitioner was informed that it was proposed to refuse passport
facilities under Section ... same. It was thus submitted that the
impugned action of refusing passport facility to the petitioner was liable
to be set aside.
