2. In Mumbai, the 'C' Ward is widely acknowledged ... structurally
unsound condition. It is here that the 5th Respondent, the SBUT,
has for the past decade or so undertaken what is conceivably

June 2018. Original Plaintif No. 7,
the Saifee Burhani Upliftment Trust ("SBUT") had already been
impleaded as Plaintif No. 7. It applied ... that amendment in paragraph 15 of my 14th
June 2018 order.
2. SBUT came into the suit as a Plaintif by virtue of a
conveyance

of Greater Mumbai. Respondent No. 4 Saifee Burhani Upliftment
Trust (SBUT) is a public trust, which has purportedly
undertaken the development ... part of a Cluster Development Scheme (CDS).
Respondent No. 4 - SBUT is the developer of the said CDS.
In the year 2011, the respondent

undertaken the development ... part of a Cluster Development Scheme (CDS).
Respondent No. 4 - SBUT is the developer of the said CDS.
In the year 2011, the respondent
allot and deliver to the Petitioners each a transit
accommodation in SBUT project in South Mumbai and in
the meantime not to pull down/demolish ... because they have now dragged in the Saifee Burhani Upliftment
Trust ("SBUT") without even making it a party to the Petition
submitted some applications before the MHADA and Saifi Burhani
Upliftment Trust (SBUT). It is alleged that, from 2012 to 2019 they
prepared forged documents ... collusion with MHADA officers and
the Trustees of SBUT to usurp that property. On these allegations
the F.I.R. was lodged.
4. Learned counsel
submitted some applications before the MHADA and Saifi Burhani
Upliftment Trust (SBUT). It is alleged that, from 2012 to 2019 they
prepared forged documents ... collusion with MHADA officers and
the Trustees of SBUT to usurp that property. On these allegations
the F.I.R. was lodged.
4. Learned counsel
notice that to
take care of the apprehension of the MHADA
and SBUT, we may need to clarify the extent of
risk which the Petitioners ... Building' and
'Khatija Building', the Petitioners shall not hold
SBUT contractor or MHADA responsible for the
said damages, yet, the said undertaking
