view we have taken, we direct that the
additional premium should be calculated by the
appellants on the basis of the rate which was
prevalent ... change of the
user. The interest should be charged on such
additional premium w.e.f. 12th April, 1984 since a
period of three months

The additional premium will cover the liability of the claimant and

8. Mr. Goswami has also relied upon another subsequent decision

be covered, additional premium has to be paid. If the

It was furthermore held :-
"13. The additional premium was not paid in respect of
the entire risk of death
risk of the pillion rider and it cannot
be said that additional premium of Rs.50/- collected was for covering
unlimited third party property damage ... relevant time. It was an Act
only policy and the additional premium was collected for the third party
property damage.The Tribunal has elaborately considered
valid for the period from 10.02.2014
to 09.02.2015, that for an additional premium was paid by the insurer for personal accident
coverage of the owner ... motor cycle and in view of payment of such additional
premium, the contractual liability of the insurer is only for an amount

premium was collected to cover the risk of other occupants

additional passenger in the vehicle in question
dismissed the claim petition on
the ground that there is no additional premium paid for the pillion
rider/deceased.
4.Against the said order ... counsel for the appellants further contended that in view of the
additional premium paid, the policy issued by the third respondent is
only comprehensive policy
