invoicing and fraudulent claim of drawback by the
exporter was held to be that of exporting prohibited goods
with reference to the requirements of Foreign ... fine.
Suffice it to notice for the present purpose that the export
attempted in violation of the conditions was held to be
taking the goods
after
he was found to have indulged in illegal trafficking and
attempt to export a huge quantity of 500 Kilograms of
Tradamol powder which ... proceedings at ICD Sanand on 22.06.2023 from where he
was attempting to illegally export the said consignment to
Democratic Republic of Congo and during
appeals on merits and now by virtue of the
impugned order re-export has been permitted and it
would result in nullifying the earlier order ... permission to re-export the goods that too
without payment of duty and penalty, by submitting
representations commencing from 23.06.2018 and
attempting to revive
balance due from the GST
Department as GST refund on export, the Income Tax
Department had issued Notice to GST for remitting refund.
Mr. Thacker ... amount were also
paid. Thus, he stated that there was no willful attempt to
evade payment of tax.
