Bank which also is similar to
the Voluntarily retirement Scheme of the appellant Bank, rejected the
argument of the Bank that the claim for pension ... Regulations, the respondent was not eligible for
pension under the Pension Regulations, 1995 of the appellant Bank.
The Court observed as under
Rural Banks
and as such, the services of the petitioner prior to his removal on
26.09.2013 are governed by Sarva Haryana Gramin Bank Pension
Regulations ... amendment has been made by the respondent
bank to the Sarva Haryana Gramin Bank Pension Regulations, 2018 so
as to provide for pensionary benefits
Development Bank (hereinafter to be referred as the
'Bank'). In few of the petitions, the petitioners are serving employees
of the Bank ... respondent Bank in its reply submitted to the petition.
The Bank then took a decision to reduce the pension of
the employees and also sought
pension, payment of
pension, commutation of pension, family pension,
updating and other general conditions etc. on the lines as
are in force in Reserve Bank ... Pension Scheme. The revision of pension/family
pension of pre-1996 pensioners/family pensioners and the
implementation of the 5th Central Pay Commission to pensioners
treated as `under orders of the
Bank' as per Settlement. The Bank, however, denied pension by relying on
Rule 29 which dealt with voluntary ... have retired shall qualify for pension.

28. SUPERANNUATION PENSION:-
Superannuation pension shall be granted to an employee
made eligible for pension; thus, the petitioner also became eligible for pension as per these regulations; the Chief Manager of the Bank vide his communication ... provides that;
"We are enclosing a list of pensions (Pensioners) who had surrendered there bank contribution and are drawing monthly pension from your branch
