applied for issuance of Basgit Parcha before the Circle Officer on
which Settlement Case no.7/2005 ... conducting local inspection and finding possession of respondent
no.8, Basgit Parcha was issued in his favour with respect to 2
decimal of land. After
case of the petitioners is that on learning about
issuance of basgit parcha with respect to his land measuring an
area of 2 decimals ... Bihar Privileged Persons Homestead Tenancy
Act, which was registered as Basgit Parcha Revision Case no.44
of 2017 which was rejected on 4.6.2020 (Annexure
that although the private
respondent nos. 9 to 12 were given Basgit Parcha but the same
was pertaining to Plot nos. 209 and not Plot ... enclosing with the same copies of the
Basgit Parcha issued in favour of the private respondents from
which also it would be evident that
certiorari quashing the order dated
13.12.2017 passed by Collector, Samastipur, in Basgit
Parcha Case No.16 of 2015 by which he has cancelled
the Basgit ... setting aside the order of Anchal Adhikari dated
10.12.2013 passed in Basgit Parcha Case No.08 of
2013-14 and or to grant any other
register of Basgit Parcha of Mauza- Ganeshpur. From perusal of
the register, it transpires that basgit parcha has been issued with
respect to 2 decimals ... with
Basgit Case no.36 of 1993-94.
It is the case of the petitioner that pursuant to his
filing of Basgit Parcha Revision Case
case
no. 41 (R)/2017 filed by the petitioner for cancellation
Basgit Parcha issued in favour of Respondent no. 3 by
Respondent
information received
by the petitioner under the Right to Information Act , basgit
parcha has been issued with respect to the land of the petitioner
writs, order/
orders, direction/directions for commanding the
Respondents to issue Basgit Parcha /or settle the
land in favour of the petitioners in Mauja
Khalilpura ... lands have not been settled and basgit parcha has not been
issued.
At the outset, a preliminary objection is raised by
learned counsel
direct the respondent No. 6
Anchaladhikari to issue Basgit Parcha in favour of
the petitioner as the petitioner No. 2 Nirmala Devi
@ Urmila Devi
