As far as the relief 'B' is concerned, this aspect has been examined above and we do not think that the present case can be decided solely on the basis of parity and the order of the Tribunal passed in OA No. 2049/2001 dated 11th April, 2003 as the said prayer stands virtually rejected by the earlier order dated 5th December, 2003 passed in OA No. 2944/2003 titled Mrs. Shashi Kala and Ors. v. Union of India and Ors. The said order has become final and binding and has not been challenged by the petitioners.

8. PW3 Ct. Girish deposed that on 22.12.2008 he alongwith Ct. Aslam were on patrolling duty on motorcycle and at around 11 pm he heard the noise of one person that his mobile phone was snatched and on hearing cry he also reached there and that person was chasing two boys and one public person was also chasing those two boys. They alongwith complainant had apprehended those boys whose name revealed as Kailash and Nurulhaq. He further deposed that complainant told them that accused Kailash put knife on his chest and other accused snatched his mobile. He further deposed that in the meantime SI Dara Singh alongwith Ct. Ghanshyam reached at the spot and from search of accused Kailash State Vs. Kailash etc. SC No. 183/10, (pg-4) one knife was recovered and one mobile phone was recovered from possession of accused Nurulhaq. In cross examination he deposed that he heard the noise of complainant from 70­80 mtrs. And further stated that he apprehended accused Kailash and Nurulhaq was apprehended by Ct. Aslam and complainant and other public persons also reached there within 20 seconds but he cannot tell the name of other public persons. He further deposed that SI Dara Singh alongwith Ghanshyam reached at the spot and prepared sketch and seizure memo at the spot. And mobile phone was recovered from right side pocket of accused Nurulhaq. Ct. Mohd. Aslam recovered the knife from right side pant pocket of accused Kailash.

In Barium Chemicals Ltd.'s case, [Editorial Comments-Please substitue the reference to the case of Mrs. Kailash Sunela & Ors. vs. Appropriate Authority-Editorial] referred to above, the decision-making process was considered relevant and for that purpose the material placed by the petitioner was required to be considered. The reason for rejecting the materials placed in support of the action for preemptive purchase has to be given. The Appropriate Authority has taken all the contentions raised by the petitioner and the reasons why the instances cited by the petitioner are not acceptable. Even in the case of Smt. Sudha Pad] referred to above, it was observed that this Court has a limited jurisdiction and even if on the material two views are possible, then it would not be proper for the High Court to substitute its conclusion for that of the Tribunal. The supervisory power contemplated could be exercised when this Court comes to the conclusion that the Tribunal has failed to consider some relevant material or the finding is based on no evidence or that the finding is such that no reasonable man can come to such a conclusion on the basis of which the finding has been arrived at. Nothing of the sort exists in these petitions. The order passed by the Appropriate Authority is well reasoned and does not require any interference. It may also be observed that the contention for valuation of the land and building separately was not raised before the Appropriate Authority and as such I do not consider it proper to examine that contention at this stage.

Therein the Appropriate Authority had formed an opinion that it was not certain as to which portion of the land would be surrendered to the State Government in view of the orders having been passed under the Urban Land Ceiling Act declaring 680.26 sq.mtrs of land as surplus. The agreement was not capable of being made certain and was void under Section 29 of the Indian Contract Act. Further the agreement was a contingent contract depending upon the orders of the competence authority under the Urban Land Ceiling Act and an NOC could not be issued in respect of an agreement which was void or contingent at best. The Appropriate Authority concluded that the statement in Form No.37-I was pre-mature and invalid. It was ordered to be filed. The second attempt of the petitioners to secure the NOC also failed on more or less the same reasoning. The Division Bench having analysed the relevant provisions of law, B.N.Kirpal, J. (as his Lordship then was) spoke for the Division Bench as under :-
