As discussed hereinabove, once the plea raised by the State with regard to non-availability of land acquisition under PMGSY, has been rejected by the Hon'ble Supreme Court in Raj Kumar's case, supra and thereafter by this Court in Bhoop Ram's case, it is not open for the appellants-State to raise the same plea time and again. The present appeal appears to have been filed by the appellants without application of mind.

Learned counsel for respondents No.1 to 8 and 11 submits that apart from the question of delay on merits also the appeal is liable to be dismissed because appeal filed in identical matter by the State being LPA No.12/2019, titled State of H.P. and others Vs. Laiq Ram Dogra, has already been dismissed by a Coordinate Bench of this Court vide order dated 23.03.2021, relying on the earlier judgment passed in LPA No.79/2017, titled State of H.P. & others Vs Bhoop Ram, against which the Special Leave to Appeal(C) No.2373/2014 filed by the State in Raj Kumar's case has been dismissed by the Hon'ble Supreme Court and the matter is covered by Vidya Devi Vs. State of H.P. & others decided on 08.01.2020, reported in (2020) 2 SCC 569.
