3. On the other hand, the present revision petition has been
vehemently opposed by the respondent. It has been argued that the Ld.
Magistrate had no option but to transfer the matter u/s 475 Cr.P.C. and
the question of limitation cannot be decided by the Ld. Trial Court. It
has been further submitted that no prejudice would be caused to the
revisionist also if accused is tried by way of court martial. Reliance has
been placed upon the judgment of Hon'ble Patna High Court in
Commanding Officer, Headquarter, Recruiting Zone (Bihar &
Jharkhand) Vs. State of Bihar 2018 SCC Online Pat 6799 and judgment
of Hon'ble Himachal Pradesh High Court in Dilawar Singh Vs. State of
Himachal Pradesh 2001 SCC Online HP 61.
