Per contra, Sri Vineet Singh, learned counsel for the respondent no. 5 submits that the instant writ petition at the instance of the petitioner who was admittedly a complainant is not maintainable as he cannot be said to be person aggrieved. Reliance has been placed upon the decision in the Case of Rahul Kumar Vs. State of UP and others reported in 2023 d(9) ADJ 614 and also in the case of Shambhunath Pandey vs. State of UP and 6 others, Writ C No. 29440 of 2021, decided on 10.11.2021 Neutral Citation No. 2021:AHC:134861.
