18. It was further argued that these decisions under Section 20 conflicted with the view adopted in the case of Bai Diwali v. Patel Girdhar (1908) I.L.R. 32 Bom. 391, s.c 10 Bom. L.R. 577 in which instalments were granted under Section 20, although the decree was passed on July 21, 1905, and the Dekkhan Agriculturists' Relief Act was not extended to the Ahmedabad District till August 15, 1905. It was argued that though the decree passed was not one against an agriculturist as defined by the Dekkhan Agriculturists' Relief Act, instalments were granted under Section 20 in execution. But Sections 2 and 20 were extended to the whole of the Bombay Presidency by Notification No. 278 dated January 21, 1903, and the defendant in the decree dated July 21, 1905, could be an agriculturist as defined by the Dekkhan Agriculturists' Relief Act.
