47. Further, reliance on University of Agricultural Sciences (supra) is
also not helpful as the case relates to the same plaintiff i.e. the plaintiff
who had filed the earlier suit had also filed the subsequent suit. The
plaintiffs in the present case and in 1973 suit are different.
