All the judgments relied upon by learned counsel for respondent has been rendered by Coordinate Benches of this Court except the case of Aley Ahmad Inter College (supra) passed by Division Bench of this Court along with the judgment passed in the case of C/M Sri Swami Krishnanad Inter College Bilwar (supra) through which the judgment rendered by Coordinate Bench of this Court dated 16.03.2022 passed in Writ Petition No.6923 of 2022 has been affirmed and the special appeal preferred by the appellant was dismissed. The ratio of the judgments relied upon by learned counsel for respondents is broadly on the basis that approval of election once approved by DIOS, but dispute regarding the election can only be adjudicated by Regional Level Committee and after approving the election by DIOS became functus officio.

Learned counsel for respondent no.4 submits that the allegations made in the writ petition and the prayer in that regard, was Charge No.6 in the disciplinary proceeding initiated by the writ petitioner against the respondent no.4 and pursuant to the order dated 29.11.2018 in Writ-A No.25191 of 2018 (C/M Smt. Sukhdevi Inter College, Amroha and another v. State of U.P. and 4 others), an order dated 29.8.2019 was passed by the U.P. Secondary Education Services Selection Board, Prayagraj. In the said order, the charge No.6 was specifically considered and it was held that the service book of the respondent no.4 is with the Manager of the Committee of Management. The said order dated 29.8.2019 has not been challenged by the petitioner.

Learned counsel for the appellants made submissions that the learned Single Judge was not justified in giving liberty to approach the Regional Level Committee to the respondents in terms of the Government Orders dated 19.12.2000 and 20.10.2008. Submissions have been made that there is no rival claim qua the Committee of Management and therefore, the proceedings before the Regional Level Committee are not maintainable.
