In Ram Chandra v. Rajasthan State Road Transport Corporation , when bus was parked by its driver at bus stand for taking passengers. One passenger boarded the bus along with kerosene oil in jerrican. He lit the match-stick for smoking bidi. Kerosene oil in the jerrican caught fire and caused burn injuries to other passengers. It was held that accident occurred in the course of use of the bus and further held that use of the bus was not confined to the period of its motion and claims were held entertainable.
