Learned counsel has taken us through paragraph No. 14.1, 14.2, 15.1 and 16.1 of the said judgment and submits that this judgment makes it clear that the Hon'ble Supreme Court has quashed Notification dated 14.03.2017 issued by the MoEF&CC and Office Memorandum dated 07.07.2021 as they provided for grant of ex post facto EC. It is also submitted by the learned counsel that the judgment of the Hon'ble Supreme Court in Vanashakti Vs. Union of India (supra) is of subsequent date than the judgment of the Hon'ble High Court Glomore Constructions and Ors. Vs. The Union of India and Ors. (supra). So the judgment of the Hon'ble Supreme Court should prevail.

Therefore, we are of the opinion that in the case in hand, we can permit for following of SOP provided under the OM dated 07.07.2021, as the application was moved by the Project Proponent much prior to the above two dates of Judgments/Orders and that we can pass the final order in this matter subject to final Judgment to be passed by the Hon'ble Supreme Court in Vanashakti's Case (supra).

On that point the State PCB was directed to submit the report and the State PCB has submitted that the Environmental Clearance was revoked vide letter dated 29.12.2023 by the Madhya Pradesh State Environment Impact Assessment Authority, during its 821st meeting held on 14.12.2023. The revocation was based on the fact that the case fell under the category of violations and in accordance with the Standard Operating Procedure (SOP) dated 07.07.2021, issued by the Ministry of Environment, Forest and Climate Change (MoEF&CC). The Hon'ble Supreme Court of India, by its order dated 02-01-2024, in the case of Vanashakti v.
