The binding dictum of M.K. Ranjitsinh & Ors. v. Union of India & Ors. (supra) therefore enjoins this Court to hold that till the State justifies validity of providing exemption on such a wholesale scale by demonstrating that it will not have any adverse effect on the environment, it is not permitted to implement the impugned exemption notification.
