Dr. Devidas Lotu Bhirud & Others vs Pachora Municipal Council & Others on 6 May, 1998

In the matter of Chief Officer, Sangamner Municipal Council v. Narayandas (cited supra) the subject was that the suit was filed for declaration challenging the legality and validity of the assessment on the ground that no procedure was followed by the authority concerned relating to levy of the tax. While dealing with the matter in the above-said judgment; the decision : Bata Shoe Company, was followed. The observations from the said judgment are more than clear which are as under :-

It has been held by this Court in the case of Chief Officer, Sangamner Municipal Council v. Narayandas Jagannath Karwa (supra) that in such cases the bar under Section 172 of the Act will operate in respect of challenge to assessment on the ground of non compliance of the Rules or of denial of principle of natural justice and of malice. This has been the consistent view of this Court.

Gandhi Agencies And Etc. vs Municipal Council, Barshi And Another on 10 February, 1995

In 1989 Mah I.J. 26, Chief Officer, Sangamner Municipal Council v. Narayandas Jagannath Karva, a similar and identical question arose about a person challenging the levy of tax on the property by filing a civil suit and then asking for the relief of injunction. A learned single Judge of this Court held that such a suit is not maintainable in view of the specific bar in Section 172 of the Act.

Municipal Council, Barshi [Reported in 1995(2) Mh.L.J. 76] also a Judgment of Apex Court in the case of Bata Shoe Co. Ltd. v. Jabalpur Corporation, . In order to decide the said issue, it would be necessary to examine the relevant provision of the Maharashtra Municipalities Act, 1965. Section 172 reads as under :
