9. So far as the ground taken by the revenue that in the matter of
Axis Bank Ltd.vs. CST; 2017 (3) GSTL 427 (Tri-Mum), wherein the
issue involved is on similar lines, they have filed an appeal before the
Hon'ble High Court of Judicature at Bombay, is concerned, I find that
there is nothing on record to show that the said appeal has been
admitted or any stay has been granted by the Hon'ble Bombay High
Court and in the absence of it, the law laid down by the Tribunal in
the matter of Axis Bank Ltd. (supra) is holding the field as on date
and it cannot be ignored.
