State and Ors reported in 126(2006) DLT 28(DB) 4.1.By citing the above judgment in Manish Singh (supra), it is submitted that if a girl of 16 years makes a statement that she went with the accused by expressing her consent without any force, coercion or undue influence, her statement could be accepted and the proceedings against the accused should be quashed. The above observation is applicable to the facts of this case also. It transpires from the pleadings made in the present writ petition particularly in para-5 that the petitioner along with seven others persons had earlier approached before this Court by way of filing a Criminal Misc. Writ Petition No. 3344 of 2020 (Manish Kumar and others Vs. State of U.P. and others) in which a co-ordinate Bench of this Court disposed of the same on 25.2.2020. On going through the said order annexed as Annexure-2 to the writ petition, it transpires that while disposing of the said writ petition, an interim order staying the arrest till submission of police report under Section 173(2) Cr.P.C. was passed so far it related to the petitioner nos. 2 to 8 therein only. So far as it related to the petitioner no. 1 i.e. the present petitioner being husband of the of the victim, the writ petition was dismissed by the same order giving him liberty to apply for bail/anticipatory bail and now the present petitioner, who is husband, has come up with the prayer to refer the matter before Mediation Centre. It does not transpire from the pleadings made in the writ petition whether the petitioner has applied for bail/anticipatory bail after the order dated 25.2.2020 passed by this Court in the aforesaid writ petition or not. Even the question of referring the matter to the Mediation and Conciliation Centre was concern, was available to the petitioner in his previous writ petition in which his prayer for quashing of the First Information Report and staying of arrest was refused.

The name of the applicant has surfaced in the statement of Manish Singh, who has already been released on bail by this Court vide order dated 02.11.2021 passed in Criminal Misc. Bail Application No.8275 of 2021; Manish Singh Vs. State of U.P. The other co-accused Vipin Awasthi, who is similar and identical to the applicant has also already been released on bail by this Court vide order dated 27.09.2021 passed in Criminal Misc. Bail Application No.4143 of 2020. It is also stated that the other co-accused, namely Ram Tirath, Pappu Jaiswal @ Amit Jaiswal and Suneel Jaiswal, the other accused in the case have already been granted bail by this Court vide its orders dated 15.9.2021, 21.10.2021 and 21.10.2021 passed in Bail Application Nos. 10145 of 2021, 11866 of 2019 and 11865 of 2019. The applicant is innocent and is in jail since 06.06.2019. Accordingly, the applicant is also entitled for bail. It is also submitted that there is no apprehension that after being released on bail, the applicant may flee from the course of law or may otherwise misuse the liberty of bail.

The petitioner, therefore, cannot be granted any benefit of the judgment in the case of Manish Kumar Singh (supra).
