8. In view of the findings given on Issues no. 1 and 2 above, the petitioners are held entitled for enhanced compensation @ Rs.59,770/­ per bigha from the amount awarded by Land Acquisition Collector, in respect of petitioners' land acquired, also detailed in the statement under section 19 of the Act, 1894, besides 30% solatium under section 23(2) of Act, in lieu of compulsory acquisition of land, interest @ 12% per annum under section 23(1) from the date of notification upto the date of award by LAC or date of taking of possession whichever is earlier; 9% interest on excess amount awarded by court from the date of possession of land to payment of excess amount in the court, for one year and 15% per annum interest on such excess amount for subsequent period of one year till amount is deposited in court. They will also be entitled for other benefits allowed in the Award by Land Acquisition Collector, Delhi. The compensation will be disbursed to petitioners as per their shares in the land as detailed in statement U/s 19 LAC No. 16/2014 Page 12 of 13 Dharampal and Ors. Vs. UOI & Ors.

PW­1/1 [to prove that market value of land determined in same area of Mubarakpur Kotla in 1964 was Rs.49,000/­ per bigha], Dharampal & Ors. vs. UOI, 98 (2002) Delhi Law Times 295 (DB) as Ex. PW­1/2 [to prove that market value of land determined area of Village Masjid Moth in 1961 was Rs.35/­ per square yard], UOI vs. Hukam Chand, 102 (2003) Delhi Law Times 162 (DB) as Ex. PW­1/3 [to prove that market value of land determined in area of Village Yusuf Sarai in 1961 was Rs.37,500/­ per bigha] and photocopy of judgment passed by Hon'ble High Court of Delhi in RFA No. 425 of 1970 in UOI vs. Babu Lal & Ors. as Mark A/PW­1 [to prove that market value of land determined in same area of Mubarkpur Kotla in1961 was Rs.35,000/­ per bigha]. The other witnesses also relied upon the said decisions/precedent. All of the PWs were also cross­ examined on behalf of Union of India. Then, petitioners evidence was closed.

Union Of India (Uoi) vs Hukam Chand on 25 July, 2002

In RFA No. 212/72, Dharampal and Ors. v. Union of India decided on 8.3.2002, , market value of land situate in village Masjid Moth, acquired through the same notification dated 24.5.1961 was fixed @ Rs. 35 /- per sq. yard. Reference Court in that case had assessed the market value at Rs. 10,000/- per bigha whereas the Collector had offered compensation @ Rs. 3,000/- per bigha.
