3. Learned counsel appearing for the petitioner argued that the petitioner had approached this Court vide CRM-M No.3476 of 2017 titled as Kulbir Singh Vs. State of Punjab and others for issuance of direction to the respondents therein to submit final report under Section 173 Cr.P.C. before the court of competent jurisdiction. The respondents therein had appeared and filed the status report admitting the innocence of the petitioner in the FIR in question. The said petition was disposed of with a direction to complete the investigation at the earliest and if the petitioner was not required then appropriate action be taken in this regard at the earliest, preferably within a period of two months. It was further argued that as per status report filed by SSP, Ferozepur dated 23.05.2022, after completion of investigation qua Shiv Kumar, Shamsher Singh, Amarjit Singh, Gurmeet Singh and Bhupinder Singh, challan has been presented against them and petitioner has been declared innocent. Therefore, since the petitioner has been declared innocent both in the initial inquiry conducted by SHO, Police Station, Ferozepur Cantt as well as in the final report submitted before the court of competent jurisdiction, the petitioner is entitled to be appointed to the post of Constable.

Learned counsel for the petitioner was unable to show that application sent on 11.2.1985 was ever accepted by the department. As per averments in the written statement, the petitioner had been intimated vide communication dated 27.1.1986 (Annexure R-1) but the petitioner failed to comply with the same. The plea of the petitioner that Annexure R-1 was never received by her cannot be accepted in the light of plea in the written statement to which there is no denial by way of replication. This Court in Kulbir Singh v. State of Punjab 1992(1) SCT 209 where on expiry of sanctioned leave, the petitioner had failed to join the duty and had sent another application for further leave which was never accepted held that only presumption in such circumstances would be that of abandonment of the post. It is further argued that the petitioner and his brother Kulbir Singh are not on cordial terms as is apparent from the FIR lodged by the petitioner against Kulbir Singh and his son. It is further argued that as the petitioner is also one of the vendees under the sale deed dated 15.09.1992 executed by Kewal Krishan, Mohinder Pal, Sawinder Pal sons of Muni Lal and Tripta Rani daughter of Muni Lal and the petitioner is in cultivating possession of the said land, the petitioner is required to be impleaded as a party to protect his interest in the lis, even if he is not held to be a necessary party for complete and effective adjudication of the matter in controversy. It is further submitted that any finding recorded by the Court on the basis of allegations raised by Sh. Kulbir Singh is likely to affect adversely to the petitioner, therefore, he is required to be impleaded as a party.
