Arvind (supra), Pradeep (supra) and Rinku @ Kuldeep Shukla

(supra) are the cases in which the powers were exercised under
sub-section (3) and not under sub-section (1)(a)(b) and (2) of
Section 3 of the NSA Act, therefore, the aforesaid three cases
squarely apply to the facts of the case at hand coupled with the
judgment of the Supreme Court in the case of Cherukuri Mani W/o
Narendra (supra).
