In another identical matter bearing MAT No.228 of 2021 (Bharat Sanchar Nigam Limited & Ors. Vs BSNL Nationlist Theka ka Workers Congress & Ors.) the respondents challenged the order dated 11.02.2021 passed by the Learned Single Judge in WPA No.9371 of 2020 (BSNL Nationlist Th Theka Workers Congress & Ors. Vs UOI & Ors.) whereupon the Division Bench of the Hon'ble High Court vide order dated 26.02.2021 stay stayed the operation of the order dated 11.02.2021 during the pendency of the appeal. It iis further stated that since the Vendors /Agencies of BSNL failed to raise the bill after due payment of PF and ESI and GST, no 27 Item No.57/ Court Court-IV IV O.A. No.670/2023 payment c could be made on account of the service services rendered by the Contract Labours, and it is the absolute failure on the part of the Vendors / Agencies who have appointed / engaged the Contract Labours.
