Mr. Gambhirwala for the State has invited our attention to a decision of this Court in the case of Special Land Acquisition Officer v. Kalyanji, and he contended taht a contrary vie has been taken by this Court in that decision and in terms the view taken by the Sind Court in F. E. Dinshwa's case (AIR 1933 Sind 21) has been expressly dissented from. He, therefore, urged that in view of the decision of Justice Tendolkar in it shoudl be held that the claimants could not claim any higher compensation under the heads 'severance' or ' in jurious affection' than the one that has been awarded by the Special Land Acquisition Officer and that such right to enhanced compensation was barred under Section 25(2) of the Act.
