This Court in the matter of Supram Prasad (supra) observed that only major son applied for giving compassionate appointment and family of the deceased was facing financial hardship, so he was held entitled for compassionate appointment. However, in the present petition, petitioner No.2 widow of the deceased employee is getting pension of the deceased employee by the order of this Court and respondent No.4 to 6 are also sons of the deceased employee. It is not clear from the reply of the respondents whether they applied for compassionate appointment or not.

According to Section 91 of the Adhiniyam, 1993 an appeal or revision against the orders or proceedings of a Panchayat and other authorities under that Act shall lie to such authority and in such manner as may be prescribed and the State Government has prescribed the Authority against the order passed by Janapad Panchayat to the Collector. Further, in view of ratio laid down in Sandeep Shukla (supra) as the State Government has conferred certain powers exclusively on Collector, so as per the maxim delegatus non potest delegare sub delegation of such power is not permissible.
